                               QUESTIONABLE PRACTICES AT CIC

Central Information Commission generally dispose of cases ordering the PIO to provide the information without giving time limit for providing the information. In such circumstances, what an appellant should do if he does not get information? Should all the Commissioners not give the time limit for providing the information in its all decisions invariably?

 

Is it justified to dispose of the case after direction the CPIO to provide information and many times, such order is not complied with?  In case the order is not complied, what should an applicant do?

 

Sometimes, the case is reminded back to the PIO/FAA for issuing the speaking order justifying the denial of information, instead of deciding the case during the hearing itself.

 

These queries are based on decision given in my case against by Mrs. Sushma Singh, Information Commissioner in a case against the Economic Offence Wing, Delhi Police recently.  It is learnt tht such practices are also prevailing for other cases also.

 

Due to the aforesaid shortcomings and deficiency, the order becomes redundeant.
