[rti4empowerment] RTI on EVM

 

A RTI has been filed with the Election Commission of India, the information to which when received should help understand whether EVMs are hack-able or not.

Following are the points of request for information sought through the RTI:

Subject: Firmware/Software Audit of Electronic Voting Machines (EVM)

In accordance with the definition of information given in section 2(f) of the RTI Act, 2005 kindly provide me with a certified photocopy of the following information 

(Each of the following points of request for information is for both: Control unit and Ballot unit - hereinafter called "both units" for the sake of brevity)

(Kindly provide a specific & separate response against each of following points with reference to subject matter)

1. Please provide a copy of the procedure whereby the checksum of the executable binary file which has been burnt into each of the programmable device (integrated circuit) used in both the Units can be audited (verified) at random at any given point in time, on any of the field deployed units.
2. Please provide a checklist of procedures to ensure confidence that both Units deployed in the field are the same as duly audited both the Units.
3. Please provide the checksum of the executable binary file which has been burnt into each programmable device used in both the Units.
4. A copy of Firmware and/or Software Audit Report of both the units
5. A copy of the Firmware Source Code of both the Units.
6. A copy of Schematic Diagram of both the Units.
7. A copy of the Service Manual related to both the Units.
8. A copy of Operating Manual for both the Units.
9. A Copy of the Communication Protocol between both the Units.
10. Legible (high resolution) photographs of both sides of each Printed Circuit Board used in both the Units.
11. Three preprogrammed samples of each of the programmable devices (integrated circuits) used in both the Units.​

Dear Sirs, 

 

It is shocking to read and hear about corrupt practices in the office of the SIC which is supposed to promote Transparency & Accountability as guardians of the RTI Act. 

 

The recent incident of a desk clerk of the Nasik bench of SIC accepting a bribe to reduce the penalty is very deplorable. 

 

It calls for an Investigation by all Commissioners about the practices being followed in their offices as to how desk officers can waive or reduce penalties as this will put into question the credibility of the orders passed and also raise doubts about the possible involvement of the IC in such arrangements.

 

This also raises the issue of non-compliance of orders in cases where penalties are imposed. As there is no serious follow up, there are cases where the PIO has retired without the recovery of the penalty and the enquiries thereafter are just manipulated. We could suggest that a public-spirited accredited NGO be given the task of follow-up of recovery of penalties which hopefully will produce results. Also ICs should consider calling for disciplinary enquiry on defaulting PIOs and also insist that entries be made about such defaults in their service records. 

 

Another observation that has been reported by RTI appellants is that the office staff from the Secretary to downwards do not maintain the office timings and report late as well as leave early. This could also be one of the issues that the investigation can look into.


All benches together must come out with a manual for standard practice, biometric attendance system, process, record maintenance as per to the

State act, digitization, discipline to be followed by staff etc so that credibility of commissions is maintained and this will also serve as an example to other public authorities about the importance of improving systems of governance in their own administrative processes

Kundapur, May 11: More than four years after the murder of RTI activist Vasudeva Adiga in Kundapur shook the coastal region, all the eight accused in the case have been acquitted.
Kundapur additional district and sessions court on Thursday May 11 acquitted all the accused and absolved them of all the charges. The verdict was pronounced by judge Rajashekar Patil.
The prime accused, astrologer Ramesh Bayari, other accused Subramanya Udupa, Umesh, Naveen, Raghavendra, Mohan, Bengaluru advocate Ravichandra and Vijay Sarathi had been arrested on charges of murder, destruction of evidence and conspiracy to murder Adiga.

The then DySP Yashoda and SP Boralingaiah had questioned 143 witnesses in the case and filed the charge sheet.
Advocates from Mangaluru Vikram Hegde, Jagannath Alva, senior advocate Ravikiran Murdeshwar, Udupi's Sanjeeva M and Narasimha Hegde were the cousel for defence. Mangaluru advocate Shivaprasad Alva was the special public prosecutor in the case.
As many as 96 witnesses were cross-examined during the trial. 
Due to lack of sufficient evidence and failure to prove the charges, the court acquitted all the eight accused.
Vasudeva Adiga went missing on January 7, 2013, and was said to have been kidnapped. Five days later, on January 12, his body was found in a decomposed state in a pond at Kadur in Chikkamagaluru. The case was registered in Shankarnarayana police station. The police had then suspected that Adiga was murdered owing to some land dispute and personal enmity. While seven of the accused were granted bail, the prime accused Ramesh Bayari's bail was rejected thrice, but the fourth time his bail plea was accepted.

New Delhi: The Central government on Wednesday admitted in the Supreme Court that Aadhaar card holders' data were indeed leaked, but maintained that there was no leakage by the Unique Identification Authority of India (UIDAI).
Arguing for the government, advocate Arghya Sengupta told a bench led by Justice A K Sikri that the leakage was by various other government departments and state agencies. Sengupta said the leakage might have occurred on account of balancing transparency and data protection concerns.
As Justice Sikri pointed out that there were reports in the newspapers even on Wednesday about leakage of Aadhaar data, Sengupta said there could be some errors here and there and some IDs were perhaps issued in the names of 'Hanuman' and dogs but UID remains the most sophisticated and authentic biometric system.
Sengupta was defending the government's new law that makes Aadhaar mandatory for having PAN cards and also for filing Income Tax returns. He said the legislature was competent to enact Section 139AA, which was inserted in the Income Tax Act under the Finance Act, 2017.
"There is no absolute right to informational self-determination," said Sengupta as he added the issue was not about discriminating between people on the basis of their having Aadhaar, but the purpose for UID was to prevent de-duplication and to ensure targeted delivery of services to the identified sections.
Stating that no enactment could solve a problem in entirety, the lawyer contended that only individuals and not companies were required to have Aadhaar since individuals were the first target. "Tomorrow, we may replace PAN with Aadhaar if such a need arises," he added.
Senior lawyer Shyam Divan, who represents the PIL petitioner in the matter, rebutted Sengupta's argument, saying it was not enough for the Centre to say that UIDAI was not leaking data. "In the eyes of citizen, all state authorities are State anyway," he asserted.
Appearing for retired Major General S G Vombatkere and social activist Bezwada Wilson, Divan questioned how the Finance Act could make getting Aadhaar mandatory when the Aadhaar Act said obtaining UID was completely voluntary.
"This scheme makes whole-time surveillance – from cradle to the grave – possible. This is perhaps the worst project possible under our Constitution. Entire architecture of Aadhaar is worthless as far as information security is concerned. We are concerned with one-seventh of the total population of the world in the wake of a scheme where degree of invasion is extremely high and protection much low," said Divan.
He said nobody can tell him not to make a big deal of concerns about a person's rights. "Civil rights movement was started by a woman who was made to sit at the back of a bus. Nobody asked her to make a big deal of this," added Divan.
The arguments in the case remained inconclusive and would resume on Thursday
