Recently, Uttar Pradesh's biggest rural festival, Saifai Mahotsava, being held at the native village of Uttar Pradesh Chief Minister Akhilesh Yadav, organised by the Samajwadi Party MP Tej Pratap Yadav was inaugurated by Rajya Sabha MP Jaya Bachchan. Ruling Yadav clan of Uttar Pradesh was present in full force at Samajwadi Party president Mulayam Singh Yadav's home district Mainpuri last Friday to launch the 17th edition of Saifai Mahotsav.


In 2013, the extravagant festival was criticised in view of the Muzaffaranagar riots. Facing flak over the festivities in Saifai, Last year Uttar Pradesh Government went too law to ban media from Saifai Mahotsav from covering the event.
However, that did not deter Samajwadi Party Government to celebrate the festival this year. Mulayam Singh Yadav went ahead and said that not only the people living in urban centers have the right to enjoy dance, but rural folks also take pleasure in it. Mulayam linked it to 'right to entertainment'.

Mulayam Singh's nephew Ranbir Singh used to hold an annual wrestling meet in Saifai but after his demise in 1997, the party started organising the event as Saifai Mahotsav every year so much so that the event became a state financed event whenever Samajwadi party was in Power in Uttar Pradesh.

This year also, Uttar Pradesh's Culture Department Secretary Anita Meshram might have made media statements that state government has approved Rs. 1 crore for the mahotsav but the fact is that the state funded Saifai mahotsavs are closely-guarded secrets for UP government so much so that Culture department's spineless officials are forced to make lame excuses and play 'Hide & Seek' with info-seeker's RTI pleas just to avert disclosure of info even when sought under RTI act.

A year ago, on 26-12-2013, this Lucknow based Social Activist Sanjay Sharma had shot off a RTI plea to the PIO of CM office of UP. On first point, Sanjay sought documents contained in files related to the whole processes from proposal to decision making regarding organizing of all Saifai Mahotsavas to which Dr. Lavkush Dwivedi of Culture Directorate of UP, on 18 December 2014, has informed Sanjay that Information sought by him is not clear. On Second point, Sanjay sought info of Money spent from state coffers on all 'Safai Mahotsavas' ( Starting from very first Mahotsava ) to which Dr. Lavkush Dwivedi has written that it was not clear in RTI plea as to details of which year were sought by Sanjay. On Third point, Sanjay sought Money earned by state Govt. from organizing of all 'Safai Mahotsavas' ( Starting from very first Mahotsava ) to which Dr. Lavkush Dwivedi has written that No such points related to income from organizing of all 'Safai
Mahotsavas' are concern of Culture Department.

"Saifai mahotsavs are closely-guarded secrets for UP government so much so that Culture department's spineless officials are forced to make lame excuses and play 'Hide & Seek' with my RTI plea just to avert disclosure of info even when sought under RTI act, so I have every reason to doubt intentions of SP Govt. in organizing such Mahotsavas" said Sanjay.

Sanjay told that on 13 January 2014,he had filed another RTI application in the office of the district magistrate, Etawah but this has got no response till date. This application sought response on the money spent in holding the event, guest list, programme list, money spent by district administration and state government and frequency of flights that operated to bring guests to the venue but on none of the eleven points information ever came. "Even UP state information commission, full of sycophant info-commissioners, refused to listen to my complaint and same was dismissed by Information commissioner Vijay Shankar Sharma" said Sanjay.

With grim picture being painted by UPSIC, the highest authority in RTI matters in UP, Sanjay feels that info on loot of public money on such events shall always remain a secret.

Terming State Govt's illogical viewpoint of providing 'Right to Entertainment' to Safai @ deprivation of 'Right to life' to homeless of UP as tragic, inhumane and autocratic, Sanjay condemned spending on Safai Mahotsava from State coffers as a shear wastage of public money and that too only to quench of thirst of unending Ego of political rulers of UP and referring the Death Toll In Uttar Pradesh Due to Cold as 125, demanded the Govt. to ensure 'Right to Life' to each n every homeless of UP before going to Safai like events.

Sanjay told that he is approaching Raj Bhavan of UP to personally meet the Governor and apprise him of this high handed approach of rulers of UP in this matter in detail to bring things to their logical ends.

'Commercial Purpose'

Not defined in the Consumers Protection Act 1986 - Consumers' Laws  Crying for Corrections

 

Hon'ble Sirs,

 

This refers to the News Item published in section of press "Consumers in Lurch as Act fails to define commercial purpose" on 22 December 2014. A clipping from the press is attached herewith as Annexure-1.

 

The Consumer Protection Act excludes services for "Commercial Purpose" from its purview, but does not define this term. This has led to chaos as the term is being interpreted differently by different judges and there is no consistency. Hence, outcome of the case has no judicial certainty and depends on the luck of the party.

Amendment to the Consumer Protection Act should incorporate a definition for "commercial purpose" so that there is uniformity in interpretation. Since the Act is meant to empower consumers, it would be ideal to keep the redressal forum open only to individual consumers and exclude business houses clogging the redressal mechanism with business-to-business disputes. 

 

As per Section 6 of the Consumer Protection Act, 1986, the rights of a Consumer are as under:

 

(a)    The right to be protected against the marketing of goods and services which are hazardous to life and property

(b)    The right to be informed about the quality, quantity, potency, purity, standard and price of goods or services as the case may be, so as to protect the consumer against unfair trade practices.

(c)     The right to be assured, wherever possible, access to a variety of goods and services at competitive prices.

(d)    The right to be heard and to be assured that consumer's interests will receive due consideration at appropriate fora.

(e)    The right to seek redressal against unfair trade practices for restrictive trade practices or unscrupulous exploitation of consumers and

(f)      The right to consumer education.

 

But in effect all these rights are infringed with impunity by the market operators, right from the Manufacturers till the street vendors and service providers. Government services are no exceptions. They are as bad as others are.

 

It's all because our laws are toothless and made with halfhearted will just to fulfill the requirement of some international declarations, covenants or treaties, to which India is a signatory and was/is under pressure from the International Community to frame laws. In fact the 'political fund' contributing business lobby is so heavily influence upon the Law Makers that the existing laws are rendered almost ineffective, specially so in the wake of their very poor implementation and wide-spread corruption. These funding caucuses have many MPs among the law makers and ensure that the laws side with them.

 

The decision or action taken on this communication may invariably be communicated to RTIFED in due course.

The Fatal combination: BJP is ruling in Delhi, Maharashtra and Mumbai ( with Shiv Sena). My house is on the junction of TPS3 , Santacruz east, Mumbai. Two days back sword wielding gang came in front of my building and build a shade overnight. This location is just 100 mts away from Main Vakola Police station. Is police involved in this? Is local ruling party leader involved? TPS 3 was developed by Britishers so it had well planned road, bungalows, huge public garden, public hospital, gymkhana etc etc.. However the entry to TPS 3 is from Regency Hotel and my building and Neelachal Society. Due to negligence of Bureaucrats and leaders and general apathy of residents of TPS 3 this corners sight is one of the worst , illegally parked tempos, drivers and cleaners urinating in open, night becomes open liquor bar and thus noise, filthy language, broken liquor bottles everywhere, and law and order problem. Police vehicle comes every night meets the dada's take their share and leave. Local corporator, MLA and MP and others too pass thru this way regularly but none thinks of beautifying or cleaning or developing this junction. As either they are in league with these elements or are callous. BMC staff makes few crores every year from all unauthorised structures in our area Santacruz east as maximum land belongs to Govt, , Military, PWD, BMC, P and T., University etc on which these officers have encouraged slums in partnership. I ask all of you is their any change u find after the fatal BJP forming government in Maharashtra, Center and Mumbai? Is their any chance of development? Is their any fear on police and BMC staff that Modi ji has come to power and they must act and also stop illegal activities. I am sorry to say I find during Kejriwal wave they acted when even common worker wearing AAP cap approached but now even people like me has no voice and goonda raj is thriving. I had even approached City survey office after Fadnavis ji took over as Chief Minister. But same attitude, callousness, rudeness and unhelping nature and greed. Behaviour in ration office and election office is same. Kya sword wielding goondo ke ache din aaye hein?

दरअसल संजय ने बीते 22 नवम्बर को मुख्यमंत्री कार्यालय के जनसूचना अधिकारी को एक आरटीआई आवेदन भेजकर यूपी के रामपुर जिले में मनाये गए समाजवादी पार्टी मुखिया मुलायम सिंह यादव के सालगिरह जश्न में हुए सरकारी खर्चों आदि की सूचना मांगी थी l संजय की आरटीआई का बिंदु 5 सालगिरह जश्न में सरकारी हवाई जहाजों के इस्तेमाल से सम्बंधित था l

बीते 5 दिसम्बर को संजय की आरटीआई मुख्यमंत्री कार्यालय से उत्तर प्रदेश शासन के नागरिक उड्डयन विभाग को अंतरित हुई l उत्तर प्रदेश शासन के नागरिक उड्डयन विभाग ने बीते 17 दिसम्बर को ये आरटीआई उत्तर प्रदेश के नागरिक उड्डयन निदेशालय को अंतरित की जिसे अगले ही दिन लखनऊ एयरपोर्ट की परिचालन उप इकाई को अंतरित कर दिया गया l

लखनऊ एयरपोर्ट की परिचालन इकाई के जनसूचना अधिकारी कैप्टन दीपक श्रीवास्तव ने बीते 19 दिसम्बर को संजय को सूचना दी है कि राजकीय विमानों का उपयोग महामहिम राज्यपाल महोदय,मा० मुख्यमंत्री जी एवं राज्य सरकार के गणमान्य महानुभावों की शासकीय यात्राओं के संपादन हेतु किया जाता है जबकि राजनेताओं के निजी आयोजनों हेतु राजकीय विमानों का उपयोग नहीं किया जाता है l

सामाजिक कार्यकर्ता संजय ने इसे एक अच्छी पहल बताते हुए सभी राजनैतिक दलों से इसी प्रकार का आचरण करने की अपील की है l

Sub. : Memorandum to sack Gayatri Prasad Prajapati & Mehboob Ali from their cabinet berths for alleged charges of corruption & a lokayukta probe to ensure free and fair inquiry against them and also to take immediate action on all reports submitted by the UP Lokayukta to Uttar Pradesh Government & to initiate departmental enquiries to fix the responsibility for the resultant loss to the state exchequer & subsequent actions to recover this money.

Uttar Pradesh Lokayukta has formally started a probe into the allegation of corruption against Uttar Pradesh state mining minister Gayatri Prasad Prajapati on the basis of 1,727 pages complaint's documents he has before him.A complaint was filed with UP Lokayukta NK Mehrotra by Om Shankar Dwivedi on December 11,2014 against the minister alleging that he has amassed wealth disproportionate to his known sources of income. In the complaint, it has been alleged that Gyatri and his family members have properties in Amethi, Lucknow and Mohanlalganj.Dwivedi also mentioned five companies in which Gyatri, his wife and son are directors.It has been alleged that the mining minister amassed assets worth crores of rupees misusing his office.

Close on the heels of allegations of the state's Mining Minister Gayatri Prasad Prajapati amassing huge wealth through corrupt deals, another minister in the Akhilesh Yadav cabinet has been accused of taking bribes to make blacklisted schools and colleges centres for the forthcoming UP board examinations.A complaint has been filed with the state Lokayukta Justice (Retd) N K Mehrotra against Minister for Secondary Education Mehboob Ali accusing him of taking bribes from the managements of schools and colleges, which had been blacklisted after allegations of mass copying there in the past examination, to allow them to become centres again this year.The complaint has been filed by the manager of a school in UP's Hardoi district. The complainant alleged that the minister had granted recognition to the schools which did not have even enough rooms to conduct classes."Lakh of ruppes had been paid by such schools to get recognition," said complainant
Bhagat Tejgiri.He also alleged that the minister was patronizing the nakal mafia, the organized gangs, which facilitate use of unfair means during the board examinations. Just a few days back, a senior official in the Secondary Education Department, who had taken on the mafia and blacklisted several schools and colleges infamous for mass copying, was removed from his post and transferred elsewhere.

Through this memorandum, we are raising our demand to sack these two ministers facing graft charges from UP Cabinet. TAHRIR demands that these cabinet ministers, who are facing lokayukta probe in alleged graft cases against them, should immediately be terminated from the post of ministers so that the investigation is not affected at all. We are sending this memorandum to both you, namely the Governor and as the chief minister of the state, with the demand to both of you, to take necessary actions to immediately sack these two ministers who face charges of corruption and a lokayukta probe because Continuing them as minister would surely affect free and fair inquiry.

We, at TAHRIR are well aware that Uttar Pradesh Governor has recently written a letter to the chief minister seeking 'explanatory memorandum' on the action taken against four BSP ministers and eight other officials against whom Lokayukta had made recommendations, finding them guilty of corruption and other charges. Referring to the special representation received from the Lokayukt in this regard, Governor has asked the chief minister to promptly make available his and chief secretary's explanatory memorandum in connection with the action taken by the government on the recommendations of the Lokayukta. We are also aware that the letter from Governor also stated that the Lokayukta, after completing the investigations, had found these four ministers and eight other officials and employees guilty of corruption and other charges and had also made his recommendations expecting to be apprised of the action taken in three months time, which had then lapsed.The
Lokayukt had send special representations to the governor recently that he had not been informed with the action taken on his recommendations against BSP ministers Swami Prasad Maurya, Avadhpal Singh Yadav, Ramvir Upadhaya and Badshah Singh and others.

We are also aware about a reminder by UP Lokayukta over disqualification of two MLAs, Bahujan Samaj Party MLA from Rasra in Ballia Uma Shankar Singh and BJP legislator Bajrang Bahadur Singh from Pharendra in Maharajganj district indicted on charges of bagging government construction contracts and holding office of profit. If this is because one of the two MLAs belongs to the BJP and a decision over termination of their memberships from Assembly has to be taken by Governor in consultation with the Election Commission of India on the inquiry report submitted way-back in February 2014. We are aware that Lokayukta has informed the governor once again about the findings of his inquiry report.

BSP MLA Uma Shankar Singh was heading a sole proprietorship firm that was awarded work contracts by PWD worth crores. Same was the case with BB Singh of the BJP. Being public servants they cannot hold an office of profit.Hence, their actions disqualify the two under section 9 (A) of the Representation of Peoples' Act and Article 191 (E) of the Constitution.

Through this memorandum, we are also raising our demand to take immediate action on all reports submitted by the UP Lokayukta to Uttar Pradesh Government and also to initiate departmental enquiries to fix the responsibility for the resultant loss to the state exchequer & subsequent actions to recover this money.
