Need of the hour is with religion teach modern education and train young for opting good vocation but why most of them r sent for Jihad????? Dvelop the idea and hv right vision. [rti4empowerment] Welcome reform by BJP in justice system

 

One is heartened to read in the media that the BJP government has directed that all undertrials who have served half of their sentence to be released, thus reducing the unfairness of a never ending judicial system, and also reducing the burden on courts and jails. Such a step was long overdue, and one hopes it will be implemented with gusto.
However, there are several other concomitant reform measures that need to be undertaken to make a meaningful and long-lasting judicial reforms in the country:

1.  Increase in the number of judges 3 or even 5-fold;
2.  JAC with a majority view to judges, not executive;
3.  JRC (Judicial Removal Commission) .... a speedy, assured, efficient, and certain  process to investigate and remove (and jail, where criminality is evident) corrupt "judges", of which variety there apparently are not just a few, but many;
4.  Other steps like curtailment of holidays, control on "adjournments", audio-video of courts, curtailment of contempt, appropriate amendments to Evidence Act and CrPC and CPC, deleting of "Single Point Directive and the likes, deleting the provision for anticipatory bail, deleting the provision that grants "judges" immunity from prosecution for their criminal acts of omission and commission, etc.

Ultimately, a country becomes developed or remains underdeveloped on the basis of the quality of its institutions ..... the parliament, courts, law enforcement systems, administrative systems, etc. One hopes that the BJP government with undertake robust, simultaneous, and multi-pronged initiatives within the first year itself.

We know of Government employees living in hutments/slums but keep amassing properties after properties in cities and villages however giving an impression that they are poor and downtrodden! In such cases it is a necessity to live in slums so that they can enjoy everything in life and have a royal life after retirement escaping action from all ills! 
Most of the builders, hand in glows with politicians and bureaucrats have to pretend as if suffering loss and the accounts are made up to reflect so! Vadra-DLF case is an excellent example showing how builders connive with the system!  50-60 crores given to Vadra under the guise of land transaction should certainly benefit DLF ro the tune of thousands of crores! Just like energy is not lost wealth/assets too are not lost, if one is a looser another is a gainer- of course within the syndicate! 2G, 3G, Coalgate scams are all the results of such arrangements!!

On the issue of justice, I have faced the incredibly bad music dished out by some of our"judges". e, I am all in favour of the proposed JAC. But the way it is framed, it reduces the role of judges to a minority level, which is not correct. Hence, I hope (and it probably will be) it will be held as unconstitutional when challenged.
At another level, it is far more important to introduce an effective and functioning accountability Bill, wherein they are not protected against criminal cases against them by private citizens, as some (many) of them are accomplices. Here, all courts should be audio-video taped, with retired judges performing random sampling of quality of judgements.

Increase the number of Judges & court rooms and also equally , if not more, important to  change the way courts work  (leaves, holidays and working hours) , curtail frequent adjournments on one or other counts and frivolous cases and PILs filed by all and sundries.

Why should cases not be started and heard rather one or other group filing appeal that case hearing be stopped ?

Cases must be decides o continuous hearing basis

What the SC has rejected is special treatment for politicians. Mr. Modi needs to increase the number of judges 3-fold so that everyone gets speedy trial, not just the politicians.

Yes Manmohan Singh never fought election and is not electable.

His statement while filing for Assam Rajyasabha seat that he is resident of Guwahati / Assam had been outright lieand that conduct of liar was reflected in his statements in Loksabha/Rajysabha  on scam & corruption statements.

Some accusations are of political nature.
Like leading demonstration etc.
These are used by the men in power to subdue the opposition.
Pakistan's Bhutto was a master in foisting such legal cases.
But Zia_ul_Haq proved to be a super master and legally sent Bhutto to his gallows. 
The Supreme Court Advice of yesterday basically concerns moral turptitude, corruption, extreme violence like murder etc.
The SoniaG led UPA's Governments under Manmohansingh had many such ministers led by Lalu_Prasad of the Chaaraa Ghotaalaa notoreity. He has been give jail sentence of 5 years but is moving freely under bail given by the Supreme Court. ( Was judge bribed? is a moot question asked) 
A Central Minister has to be a M.P.
A member of Loksabha or Rajyasabha counts as M.P.

While looking the net for Indian news, I have come across this item. Surely NM does not have any tainted ministers in his cabinet – though the website seems to indicate that there are !! Nm wanted, above all, to have a clean administration and amongst others, root out corruption.
 
Any comments? Do ministers have to be MPs?

This is a very serious issue and marital relationship experts, sexologists,  urologists, counselors , NGO's and even govt after govt have failed to raise alarm on this issue. Parents, groom and even bride hide even serious physical ailments which do not allow marriage responsibility to be performed. Having a partner in bed ( specially in new marriages and unable to act and perform is like RCC roof falling on head. I salute Madras High court for raking up this issue.  It is like when u want anything even if smallest then u want it to be perfect atas at that time. But if one is disable, having extra marital relations, is mentally unfit, is financially under heavy debt and if all this is hidden from spouse at the time of marriage then it should all be punishable to spouse and even guardians behaving irresponsibly. In a case of Nishant Paras Jain of Kota , abu dhabi the Nishant had deep physical and emotional relations with his colleague a divorced lady . This commitment did not allow him to enjoy and give joy to a  wife  whom he married due to force from parents.  and all love letters, photos of honeymoon with girl friend were found. Soon the marriage broke.  I do not know when laws are very strict , when failure rate of marriages are so high, when fit men women too  are unable to control their hunger for variety and novelty then how one young lady can remain in denial state for years and years for what is her birthright, a god given need, and environment is full of lust and glamour. Present society is such that even if u want to be saint but can not be as there is tamas / heat everywhere. .........I think Madras high court has played a very responsible role and needs to be applauded with standing ovation. ......Here I will add that many dysfunctions can be over come with the intervention of a modern treatment and surgeries. There are solutions available but due to lack of sexual education people are not comfortable to go to doctors. And if one wants to then he does not know where and whom to go to. I wish that some big philanthropists  start institute of sexology on the lines of heart institutes where all relationship issues be in biological, psychological are tackled at highest level.  ......None tells you this except ......Alok


Make pre-marital clinical tests mandatory: HC
Noting that impotency or frigidity were serious social problems that often broke marriages, the Madras high court has suggested making pre-marital clinical tests mandatory for grooms. These ills often led to violation of human rights, especially for women, the high court observed and sought the views of the Central and State governments and asked them to file their replies by September 5.

Justice N Kirubakaran said if a person was suffering from impotency, it was not revealed due to social stigma and such omissions hurt people eventually. Dealing with a petition by a Theni-based man who sought the quashing of a petition under domestic violence Act filed by his wife, Justice Kirubakaran said impotency was the cause for the violence against the woman.

If people kept hiding this illness, more innocent people could become victims, the judge felt.

Some may even commit suicide. "It is an avoidable human tragedy," the judge said in his order.

"Therefore, the issue needs urgent discussion, deliberation and a suitable law and remedial as well as preventive measures," the judge said.

The judge also suggested amendment to marriages laws and fast track matrimonial cases filed on the ground of impotency and frigidity to be decided within six months or one year and whether punishment could be awarded for suppression of these ailments before marriage. He sought the government views on this as well.

Social stigma or conforming to social values and norms must be preventing persons with such disabilities to suppress their ailment. Women tend to be the worst suffers, the judge said

"If pre-marital tests were made mandatory, they could help not only in preventing the impotent or the frigid getting married but also can help preventing people from marrying people suffering from dangerous and incurable diseases such as AIDS/HIV, " the judge said.

The judge also lamented that "girls are often treated as unnecessary luggage and it is a grim reality in this era of women empowerment. Without even proper minimum verification of the prospective groom they are discharged from the family in the name of marriage." The result of such a marriage is this kind of a matrimonial case, he said.

Most construction companies are saddled with huge debt / inventories on their books. This has been the case for the past few years, because demand is not picking up as hoped for by the builders.
Companies all over the world slash prices to clear inventories and to clean up the clogs. It is time that our builders learnt some basics of modern-day business tactics and strategies and slash prices to swiftly clear up their unsold stocks and clean up their balance sheets. Were they to do this, they would find the market reviving and expanding (something like the last recession when the banks sold off stocks).
The government can also play its part by "advising" the builders. If the builders do not pay heed, it can "advise" the banks and financial institutions.

NAGPUR: With a view to stop frivolous petitions that were used by the alleged blackmailers for their vested interests, Nagpur bench of Bombay high court on Wednesday asked an RTI activist to deposit Rs 1 lakh to prove his bona fide before hearing his Public Interest Litigation (PIL) about alleged financial irregularities in Nagpur Municipal Corporation (NMC).


The court's directives came just a couple of days after Supreme Court's refusal to interfere with an Allahabad High Court order asking a persistent PIL litigant to deposit Rs 25,000 with every case she filed. In 2005, even the Law Commission recommended to the Centre to prevent frivolous litigation by enacting a law on the lines of Madras Vexatious Litigation (Prevention) Act of 1949.


A division bench of justices Vasanti Naik and Pukhraj Bora asked Mukesh Sahu's counsel Srikant Khandalkar to complete formalities before adjourning the hearing by two weeks. The judges made it clear that notice would be issued to respondents only after the petitioner deposited the amount with the court registry. Recently, while hearing a PIL against shops and establishments at Telangkhedi promenade, the court had asked the shopkeepers, who had filed petitions against NIT for same cause, to deposit Rs 23 lakh with its registry.


Citing an audit report, Sahu had demanded a probe into alleged misuse of public money by the NMC. He pointed out a string of irregularities by the civic officials while awarding tenders or contracts between 2002 and 2011. Union secretary for rural development, state secretary for General Administration Department (GAD), NMC commissioner, and superintendent of anti-corruption department among others were made respondents.


The Allahabad High Court had asked petitioner Nutan Thakur, known for filing PILs on various issues who had clocked a score of 86 petitions so far, to deposit money with every new PIL she would be filing. The court made it clear that the deposited amount would be refuned only if it found the PIL to be advocating a genuine public cause.


Asserting that no one can rush to the court with a PIL for every headline in newspapers, the three-judge supreme court bench of chief justice RM Lodha and justices Kurian Joseph and RF Nariman, stated that there was a need for a law in every state to curtail vexatious and frivolous litigations. "In Maharashtra, there is a Vexatious Litigation (Prevention) Act of 1971 that needs to be enacted by every state," it said.


Hailing the court's decision, Jan Manch president and noted lawyer Anil Kilor, who had filed many PILs on behalf of his organization, said the move would act as a deterrent for the petitioners who misused this tool to settle personal scores or to blackmail. "The apex court had directed all high courts to ask petitioners to deposit the money if it found something fishy in the case. If it is proved that the case was filed for settling scores or for vested interests, that deposit could be forfeited. It is only way to keep a check on frivolous PILs," he said.
