[rti4empowerment] We can file a complaint against corrupt public servant

In a landmark verdict, the Supreme Court on Tuesday upheld the right of a private citizen to seek sanction for prosecution of apublic servant for corruption, while setting a deadline of four months for the government to decide the issue of giving sanction for prosecution of public servants facing graft charges.

According to a PTI report, a bench of Justices G S Singhvi and and A K Ganguly rejected the argument of attorney general G E Vahanvati that Janata Party chief Subramanian Swamy, also a petitioner in the 2G case, had no locus standi to seek sanction for prosecution of former telecom minister A Raja.

The SC said, "There is no provision in the Prevention of Corruption Act or CrPC which bars a citizen from filing a complaint for prosecution of a public servant who is alleged to have committed an offence." The SC also turned down Vahanvati's argument that the issue of sanction for prosecution arises only at the stage of taking cognizance of the case by the court.

In my opinion, this is land mark judgement and would go a long way in eradicating corruption, by EMPOWERMENT of citizens to act as watchdogs. Legal experts would analyse the implications.

Bangalore: A 31-year-old techie working with a multinational corporation got an unregistered chemist in Banashankari to cough up a Rs 3-lakh fine to the commercial taxes department. All through a Rs 10 Right to Information application form.
Amit Deshpande stumbled upon the racket after he saw that the bills, given to a family member who purchased medicines from the chemist, didn't have a Taxpayers' Identification Number (TIN). There were even Scheduled H drugs given without a doctor's prescription. Drugs which cannot be sold over the counter were freely available.
 "In October 2011, I wrote a letter to the proprietor questioning him about these things, but he never responded. I filed an RTI application with the commissioner of commercial taxes to find out whether he was a registered dealer. Based on that, commercial tax officers conducted an inspection of the chemist's shop and found he was an unregistered dealer," Amittold TOI.
Amit recently got a 'Thank You' letter from the office of additional commissioner of commercial taxes (enforcement) for being a whistleblower.
 "During out inspection, we noticed that the chemist was not registered. All purchase bills for 2009-10, 2010-11 and 2011-12 have been taken. The dealer has accepted the discrepancies and agreed to discharge the tax liability. The total tax liability is Rs 3 lakh," said MS Sathyaprakash, assistant commissioner of commercial taxes, south zone, Bangalore.
The dealer paid the tax due and was also made to procure a Value Added Tax Registration Certificate.

Standing committee points out multiple faults in UID 'Aadhar', asks government for fresh legislation


NEW DELHI: The former finance minister and senior BJP leader Yashwant Sinha-headed standing committee on finance has picked multiple holes in the much-hyped Unique Identification 'Aadhar' Scheme and asked the government to bring forth a fresh legislation before Parliament. The key objections of the committee on the National Identification Authority of India Bill, 2010 include:

NO FEASIBILITY STUDY: No comprehensive feasibility study -- including cost-benefit analysis, comparative costs of aadhar number before approving such an expensive scheme vis-avis various forms of existing identity such as hologram-enabled ration card to eliminate fake and duplicate beneficiaries -- carried out.

APPROVED IN HASTE: Absence of data protection law would make it difficult to deal with issues such as access and misuse of personal information, surveillance, profiling, linking and matching of data bases and securing confidentiality information.

SECURITY GAPS: Entrusting the responsibility of verification of information of individuals to the registrars to ensure that only genuine residents get enrolled into the system may have far-reaching consequences for national security. The panel not sure as to whether complete verification of information of all aadhaar number holders is practically feasible and whether it would deliver the intended results without compromising national security.

DIRECTIONLESS: The UID scheme has been conceptualised with no clarity of purpose and is being implemented in a directionless way and may end up being dependent on private agencies.

UNRELIABLE TECHNOLOGY : The scheme is full of uncertainty in technology as the complex scheme is built on untested, unreliable technology and several assumptions. Despite adverse observations by the UIDAI's biometrics standards committee on error rates of biometrics, the UIDAI is collecting biometrics information.

LIMITED COVERAGE: It is not clear that the UID Scheme would continue beyond the coverage of 200 million of the total population. The exercise could become futile in case the government does not give further mandate.

LACK OF COORDINATION: Serious differences of opinion within the government on the UID Scheme. The Department of Expenditure, ministry of finance, has expressed concern that lack of coordination among at least six agencies collecting information --National Population Registry, MNREGS, BPL Census, UIDAI, RSBY - is leading to duplication of efforts and expenditure.

The Home Ministry has raised serious security concern over involvement of private agencies in large scale scheme. The Ministry of Planning has expressed reservation over the merits and functioning of the UIDAI and the necessity of collection of iris image.

The National Informatics Centre has pointed out that issues relating to privacy and security of UID data could be better handled by storing in a government data centre.

KIC has virtually made the section 18 as defunt and quashed it and changed the basics of RTI Act. It is not correct and KIC has no such power. Even the recent Supreme Court has not given such sweeping jugement rendering section 18 worthless and has only said that information cannot be asked by invoking this section and this section should be used to penalize PIOs, not for giving infn.

In my opinion, applicants are free to use section 18 or 19 simultenously in the light of the SC decision, first appeal for getting information and complaint for non-receipt of reply of RTI application and other provisions of section 18.   Pl. note that FAA has no power to penalize the PIO, therefore complaint to Infn. Commission.

This a country of total indiscipline and chaos.The current political dispensation (which has unfortunately been current for 60 years,one doesn't know how!) is not into governance but into gobble-nance!

In another mail, I talked of Dr Raj Kumar Dube, Principal of District Institute of Education and Training (DIET), Baraut, District- Baghpat who has been waging a single-handed battle against corruption at Baghpat. He got the FIR lodged at case crime No. 238 of 2011, under sections 420, 468, 471 IPC, PS Baraut, district Baghpat which later Allahabad High Court directed to be transferred to CB-CID. Allahabad High Court is also monitoring the case in a very detailed manner.
When Dr Dube came to our house today at Lucknow, he told me an interesting story. He said that once he was asked to pay Rs. 25,000 to the District President of the ruling party for a particular occasion, which he refused straight away. When the party President complained to the District Magistrate, instead of refusing to interfere in the matter, the DM asked Dr Dube about this, saying that he shall cooperate with the Party President. Dr Dube not only refused once again to the DM, he also immediately wrote to a very senior officer in Government about the entire event, taking the DM's name.

Today, Dr Dube is the man responsible for unraveling the big scam of obtaining fake mark sheets from the Madhyamik Shiksha Mandal, Bhopal and the Sampurnanand Sanskrit University, Varanasi for the purpose of getting admission in B.T.C. courses for securing government jobs of primary school teachers.  Certainly a great man! I have rarely found a man of his character in the setup I work. We need to appreciate all such people who are true gems of our society.

Dr Dube has been facing all kinds of hardships in the process. Among other problems, he faced FIRs by a RTI and social activist supported by no less a person than Sri Arvind Kejriwal and Ms Kiran Bedi who personally went to Baghpat to support this so-called RTI activist and gave evidence in his favour. Dr Dube wrote to both asking them to listen to his facts and said in his letter- "If you are a true nationalist, kindly listen to me also and then take sides with a person who is a part of scam." He says in another letter- "I give open challenge to Sri Arvind Kejriwal and Ms Kiran Bedi that if they listen to my side of the story, they will start feeling ashamed of openly assisting a Bad character. I am no less nationalist than them. If they are International Social activists, I am also an internationally recognized mathematician. How can they try to denigrate me without knowing the full facts?"  He never got a reply from either Sri Arvind Kejriwal or Ms Kiran Bedi, who had once again recently gone to support this "social activist" from Baghpat.

Dr Dube continues his single-handed battle against wrong-doings despite all hardships. I do feel privileged to know this wonderful person.
