This is a very serious issue and marital relationship experts, sexologists,  urologists, counselors , NGO's and even govt after govt have failed to raise alarm on this issue. Parents, groom and even bride hide even serious physical ailments which do not allow marriage responsibility to be performed. Having a partner in bed ( specially in new marriages and unable to act and perform is like RCC roof falling on head. I salute Madras High court for raking up this issue.  It is like when u want anything even if smallest then u want it to be perfect atas at that time. But if one is disable, having extra marital relations, is mentally unfit, is financially under heavy debt and if all this is hidden from spouse at the time of marriage then it should all be punishable to spouse and even guardians behaving irresponsibly. In a case of Nishant Paras Jain of Kota , abu dhabi the Nishant had deep physical and emotional relations with his colleague a divorced lady . This commitment did not allow him to enjoy and give joy to a  wife  whom he married due to force from parents.  and all love letters, photos of honeymoon with girl friend were found. Soon the marriage broke.  I do not know when laws are very strict , when failure rate of marriages are so high, when fit men women too  are unable to control their hunger for variety and novelty then how one young lady can remain in denial state for years and years for what is her birthright, a god given need, and environment is full of lust and glamour. Present society is such that even if u want to be saint but can not be as there is tamas / heat everywhere. .........I think Madras high court has played a very responsible role and needs to be applauded with standing ovation. ......Here I will add that many dysfunctions can be over come with the intervention of a modern treatment and surgeries. There are solutions available but due to lack of sexual education people are not comfortable to go to doctors. And if one wants to then he does not know where and whom to go to. I wish that some big philanthropists  start institute of sexology on the lines of heart institutes where all relationship issues be in biological, psychological are tackled at highest level.  ......None tells you this except ......Alok


Make pre-marital clinical tests mandatory: HC
Noting that impotency or frigidity were serious social problems that often broke marriages, the Madras high court has suggested making pre-marital clinical tests mandatory for grooms. These ills often led to violation of human rights, especially for women, the high court observed and sought the views of the Central and State governments and asked them to file their replies by September 5.

Justice N Kirubakaran said if a person was suffering from impotency, it was not revealed due to social stigma and such omissions hurt people eventually. Dealing with a petition by a Theni-based man who sought the quashing of a petition under domestic violence Act filed by his wife, Justice Kirubakaran said impotency was the cause for the violence against the woman.

If people kept hiding this illness, more innocent people could become victims, the judge felt.

Some may even commit suicide. "It is an avoidable human tragedy," the judge said in his order.

"Therefore, the issue needs urgent discussion, deliberation and a suitable law and remedial as well as preventive measures," the judge said.

The judge also suggested amendment to marriages laws and fast track matrimonial cases filed on the ground of impotency and frigidity to be decided within six months or one year and whether punishment could be awarded for suppression of these ailments before marriage. He sought the government views on this as well.

Social stigma or conforming to social values and norms must be preventing persons with such disabilities to suppress their ailment. Women tend to be the worst suffers, the judge said

"If pre-marital tests were made mandatory, they could help not only in preventing the impotent or the frigid getting married but also can help preventing people from marrying people suffering from dangerous and incurable diseases such as AIDS/HIV, " the judge said.

The judge also lamented that "girls are often treated as unnecessary luggage and it is a grim reality in this era of women empowerment. Without even proper minimum verification of the prospective groom they are discharged from the family in the name of marriage." The result of such a marriage is this kind of a matrimonial case, he said.
