Dear Sirs, 

 

It is shocking to read and hear about corrupt practices in the office of the SIC which is supposed to promote Transparency & Accountability as guardians of the RTI Act. 

 

The recent incident of a desk clerk of the Nasik bench of SIC accepting a bribe to reduce the penalty is very deplorable. 

 

It calls for an Investigation by all Commissioners about the practices being followed in their offices as to how desk officers can waive or reduce penalties as this will put into question the credibility of the orders passed and also raise doubts about the possible involvement of the IC in such arrangements.

 

This also raises the issue of non-compliance of orders in cases where penalties are imposed. As there is no serious follow up, there are cases where the PIO has retired without the recovery of the penalty and the enquiries thereafter are just manipulated. We could suggest that a public-spirited accredited NGO be given the task of follow-up of recovery of penalties which hopefully will produce results. Also ICs should consider calling for disciplinary enquiry on defaulting PIOs and also insist that entries be made about such defaults in their service records. 

 

Another observation that has been reported by RTI appellants is that the office staff from the Secretary to downwards do not maintain the office timings and report late as well as leave early. This could also be one of the issues that the investigation can look into.


All benches together must come out with a manual for standard practice, biometric attendance system, process, record maintenance as per to the

State act, digitization, discipline to be followed by staff etc so that credibility of commissions is maintained and this will also serve as an example to other public authorities about the importance of improving systems of governance in their own administrative processes
