Secretary of the Information Commission to enquire complaint against the CIC ?
I had send a complaint against Sri Ranjit Singh Pankaj, the Chief Information Commissioner of Uttar Pradesh about his supposed improper behaviour with one Sri Pawan Agrawal of Moradabad in hearing of Appeal No S-1-16 C/2009 and Appeal No S-1-...750 C/2009. That was way back on 10/06/2010. I did not hear anything about the enquiry being conducted in that matter so far. Ironically, what I got instead was a letter No Ra.Pa.-12/42-2-2010 dated 02/11/2010 from Ram Chandra Yadav, Deputy Secretary of the Administrative Reforms Department of the Uttar Pradesh government about this complaint. Now this State government letter says that – "As per the Right to Information Act 2005, the Government has no right to intervene in matters that are pending before the Information Commission. Hence the State government can't give any directions to the Information Commission in this regards." It also adds that of the complainant has any grievances against the Hon'ble Commission then it might appeal at the appropriate forum. With this conclusion, this letter has been sent to the Secretary of the State Information Commission to take necessary action.
I had not asked the State government to give any directions to the State Information Commission not was I aggrieved by any decision of the Commission. In fact my letter was a complaint against the personal behaviour of the Hon'ble CIC on the information we had received from reliable sources. But instead of getting it enquired, the complaint has been sent to the Secretary of the Commission. Could it be possible for the Secretary of the Commission to enquire into a complaint against his own CIC?
In the light of the above facts, I have requested the Governor of Uttar Pradesh you once again to retrieve the letter back from the Secretary, SIC's office and get it enquired at his end
