Hon'ble Sir,
The Dwarka Forum takes the liberty to draw your kind attention to the fact that in a number of decisions, some Information Commissioners fail to mention the date by which the information should be provided to the Appellant. However, the Commissioners, including your goodself, simultaneously state in the order that the case is disposed of. This left the Appellants directionless about the next course of action in case the CPIOs fail in providing the information. Thus many Appellants are not able to get information at all and ironically, they are also not aware of the further course of action to be taken in such circumstances.
2. The Dwarka Forum take the opportunity to suggest for advising all the Commissioners for mentioning without fail the maximum time for providing the information or for the compliance of the order. They should also mention that in case the CPIO fails to comply the order, Appellant has option to approach the Commission again for the non-compliance of its order.
3. In some cases, Commission issues Show Cause Notices to the CPIOs and in such cases, it should also direct the CPIOs to give a copy of the reply to the Appellants also and the appellant should also be given minimum 10 days for submitting their objections to the reply of the CPIO in case they find the reply not in accordance with the order.
