[rti4empowerment] Re: legal advice required

Dear Mrs Babita

The slang used is very rude and insulting to female sex.

It essentially means that a woman has been screwing around (please
don't report me) in an adulterous relationship and has been caught in
the act.

The phrase originally was "don't bunch your boxers". It referred to
when a man was discovered screwing another man's wife and was
discovered by the furious husband who was banging down the locked
bedroom door. The adulterer while trying to put on his undershorts
(boxers) got them tangled (bunched / twisted) up and got panicked.
Later this was extended to the female sex with the term "bunch"
replaced by "twist" and "boxers" by "panties".

Legally speaking though, the Indian Supreme Court has repeatedly held
that obscenity has to be put in its proper place and perspective.
Since Rajeshwar Rao is in USA where the moral standards are lower and
you have provoked him repeatedly on this group, it is unlikely that a
successful prosecution would result, although you would probably
garner some sympathy and publicity.

The information was denied to us on grounds that IB is exempted organisation in schedule of RTI Act CPIO of M.E.A also did not transfer the RTI application to IB as is compulsory under section 6 f RTI Act. CPIO also submitted that "RTI activist" is not a defined term and no such information exists / maintained.

The matter was referred to Central Information Commission which directed the MEA to transfer request to IB to provide the list. We have received the list about 115 days after the CIC order but do not intend to complain as legal opinion sought by IB thereafter was also provided to us to explain the delay. The list of almost 600 names is shocking and even includes name of late RTI martyr Amit Jetwa.
