Swabhiman III
Friends, I just read that the Indian Govt has taken up the Krittika Biswas case very seriously with the US Govt. via Meera Shanker, the Indian Ambassador in Washington. I almost fell off my chair laughing thinking if anyone expected something to come out of this they must be mad.
For those not familiar with this Krittika Biswas case, someone sent threatingemails to two teachers of John Bowne High School in Flushing, NY.
Krittika Biswas, daughter of the vice counsel at the Indian Consulate in Manhattan, Debashish Biswas, who studied there was wrongly arrested, handcuffed, threatened that she would be put in jail with rapists and HIV+ under trials and had all other kind of mind games played with her. She was held incommunicado for 6 hours when she was arrested at 11 AM and only allowed to speak to her father at 5 PM later that day.
It was later found that someone else, a Chinese student from the same school had sent the threating mails that were attributed to her and to date that person has not been arrested.
I have already written about how we have not been able to uphold even an iota of self respect in front of the Americans in my earlier article Swabhiman II.
Earlier, George Fernandes has claimed that he was strip-searched twice at Dulles Airport in the US Capital area, when he was defence minister ergo on a diplomatic passport once on an official visit to Washington in early 2002 and another time while en route to Brazil in mid 2003.
The details of the strip-search were mentioned in American foreign policy analyst Strobe Talbott's book Engaging India - Diplomacy, Democracy and the Bomb. However, the US embassy in Delhi issued a formal denial against this incident and no one has even bothered to check the facts or follow up after that.
We must note that persons travelling on State business abroad are called diplomatic agents and travel under diplomatic immunity. This is governed by the Vienna Convention on Diplomatic Relations, 1961. (full text of these rules available here)
Under Article 29 of this convention it states:
The person of a diplomatic agent shall be inviolable. He shall not be liable to any form of arrest or detention. The receiving State shall treat him with due respect and shall take all appropriate steps to prevent any attack on his person, freedom or dignity
This means that the touching of George Fernandes body while he was on a diplomatic journey was an insult to our sovereignty and and "attack on our dignity".
Wait a minute, Meera Shanker, the name does sound familiar doesn't it Why should it not since Meera Shanker is the self same Indian Ambassador who on 4th Dec 2010 at Baltimore Airport was patted down by a normal lady Transit Authority security agent. Isn't that insult added to injury. Why did the US do this, it did it because because it knew that we were gutless wonders and would never do anything except register a dead end protest.
Meera Shanker at the time of this insult held the highest of high posts an Indian can hold in a foreign country and that is of India Ambassador. She was and is India personate in the USA.
Now the Americans are quoting Article 37 (2) of the Vienna Convention on Diplomatic Relations, 1961 in Krittika Biswas's case which states:
Members of the administrative and technical staff of the mission, together with members of their families forming part of their respective households, shall, if they are not nationals of or permanently resident in the receiving State, enjoy the privileges and immunities specified in articles 29 to 35, except that the immunity from civil and administrative jurisdiction of the receiving State specified in paragraph 1 of article 31 shall not extend to acts performed outside the course of their duties.
This they say means that families of diplomats do not enjoy diplomatic immunities .100% agreed technically. If that is the case will our Govt stop turning a Nelsons eye to the blatant disregard for law and order on every nukkad and in every nightspot in Delhi by families of Diplomats.
Why can the Americans think they can bully us like like this, simple they can because we give off the image that we have a spineless government which kowtows to the slightest threat.
For example, Gilani from Pakistan went on record and said India would be foolish to try an Abbotabad and what did our government do they rushed to send a clarification that we had no such ideas.
Gilani tried the same stunt with America and what does Obama do goes onrecord saying that we cannot allow anything to threaten American lives so we will undertake as many covert operations as necessary.
This language of you touch me and I smash your face is the only one all the world understands. Has no one wondered why the UK is being made a target of the Al Qaida for the revenge of death of Osama when America is the one who killed him ..simple they know that if they try something in America .its bye bye the country which protects them ..
What do we do when a 26/11 happens .we act as hosts for the terrorist ( Kasab) and offer him Biriyani.
