Dear Sir/Madam,
We had sent an application under Section-6 of the Right to Information Act, 2005, to the Public Information Officer (PIO) of the State Information Commission (SIC) for obtaining information and documents of an employee which he had submitted with his/her application for appointment within the said State Information Commission itself.
The PIO denied to furnish this information stating that the concerned employee has requested in writing that his/her documents are personal information and have no relationship to any public activity. Hence, it shall not be disclosed. Thereafter, we submitted 1st appeal thereto with the Appellate Authority on 01-11-2010, but the same has not been decided till date.
What is the current legal position and what can we do next? Are these type of cases decided by SIC, CIC, High Courts or Supreme Court of India? Is there any other argument to this case?
Please guide and provide your valuable inputs, and oblige.
