Against the "Jugad" culture

 

My husband and IPS officer Amitabh today filed a contempt petition in the Allahabad High Court, Lucknow Bench against Kunwar Fateh Bahadur, Principal Secretary (Home) and Karamveer Singh, DGP, UP. This contempt petition has been filed by him in the study leave matter related with his 2 years study at IIM Lucknow.  In this case in Original Application No 238 of 2010, on 7th July 2010 the Central Administrative Tribunal had dismissed the grounds on which the State government had refused study leave to Amitabh and had ordered the State government to reconsider his study leave matter as per law within 4 weeks.


When the State government had failed to comply with the CAT order Amitabh had filed a Contempt Petition No 57/2010 in CAT against G K Pillai, Home Secretary, Government of India, Kunwar Fateh Bahadur and Karamveer Singh.. When notices were issued to the three officers, the State government filed a Writ petition No. 268 of 2011 in High Court against the order of CAT. This Writ petition was dismissed by High Court on 09th March 2011 which said that the order passed by the learned Tribunal seemed to be a well reasoned order and was based on well appreciation of evidence on record. High Court said that there appeared no good ground to interfere with the impugned order of the learned Tribunal. In view of this, the High Court dismissed the writ petition with the direction to the Principal Secretary (Home) and DGP to take a decision in terms of the CAT order expeditiously within a period of two months.


Amitabh had submitted this order before the State government on 11th March and hence the period of two months given by the High Court is over. Hence he has filed this Contempt Petition against Fateh Bahadur and Karamveer Singh.

This is the seventh court case in this matter. Interestingly, meanwhile Amitabh has joined his service on 17th February 2011 after the end of his two year extraordinary leave.


Now for us this case has become much more important than its result and the process has acquired great relevance. I know that if today Amitabh tries to get his work done through some side quarters and political connections, it will not take long to get the task accomplished. But Amitabh has decided to face all kinds of hardships but to adopt the legal way prescribed. I am not glorifying him nor I am saying that he is some wonderful person. All I am saying is that in this particular case, he has done something which we all shall take as an example and shall try to follow it in our own ways.


Such a tendency is very much needed in India because somehow we have got too much accustomed to what we call the "Jugad" culture where all we are looking for is some connection to get our job done, thru hook or thru crook. This culture is counterproductive to us all through everyone of us, including me are falling prey to this day and night.
