You might be remembering an Article I had sent you titled- "Constable Sri Brijendra Yadav is a man possessed". There I had presented the story of Mr Brijendra Yadav, a constable in the Uttar Pradesh police. At that time, he was posted in Ghazipur. Till that time, as per his version, he has once been terminated from the service, has been suspended four times, has got transferred umpteen numbers of times and has also been charged under serious offences.

Sri Yadav has been pursuing the cause of forming an Association or appropriate forum for the Non-gazetted police officers of Uttar Pradesh. He has also been pursuing the case of alleged misappropriation of funds by senior officers of the Police Department over a long period. He claims that through an organization registered in 1961 and not renewed since then, as per the Societies Registration Act, having only IPS officers and their wives as its committee members, an amount of Rs. 25 per month per police person is being deducted from every police up to the rank of Inspector making it Rupees 10.5 crore per year. He also talks of another scheme where Rs. 340 per person per year gets deducted. As I had told you earlier, he has filed a Writ Petition in the Allahabad High Court about this alleged misappropriation.

Now, Sri Yadav has been suspended once again. The order says that he has not being interested in government work, has being engaged in unnecessary work and has interacted with media without permission. The order says that these misconducts of Sri Yadav have diminished the police image in the eyes of the people.

This being an order of a senior officer, I can make no comments upon it. But during the last few days I did interact with a large number of police personnel in the lower ranks, who seemed to be having entirely different views about Sri Yadav. Many of them were even regarding him as their saviour, who was sacrificing his own comforts for their sake. Look at what one of the Constables told me-"Sir, you people still think you are living in a monarchical system, where there are different rules for different people." They were all praise for Sri Yadav.

On my previous mail, one of my IPS friends had commented- "Your XXXL size post belie your engineering background. Algebraically, it is: at+by-c=0 (where, at - amitabh thakur, by - brijender yadav, c - content). Supposedly, it meant that whatever I had written there, praising Sri Yadav and emphasizing upon a need for such associations, were content wise a big zero.

But somehow, it seems to me that times are changing very fast and we, as IPS officers and leaders of the force, will have to realize this as soon as possible. The basic principles of Human Resource Management, as taught and applied in other sections of society, will need to be implemented in almost equal measures in the Police force as well. Ignoring the signals has always proved to be dangerous (not talking at an individual level, but for a group).

Constable Sri Brijendra Yadav is a man possessed

We all belong to the coveted Indian Police Service, and being a member of this service, have been enjoying the privilege of being the leader of the huge police force. Here I present a case before you to show how a person who is dedicated to a cause can make his/her impact felt despite all odds. I don't know whether this person's claims are true or false but the way he has been pursuing his cause is certainly something that we simply can't ignore.

This person is Mr Brijendra Yadav. He is a constable in the Uttar Pradesh police. Presently he is posted in Ghazipur district at some distant police station. Possibly in his mid fifties, as per Mr Yadav's own version, he has once been terminated from the service, has been suspended four times, has got transferred umpteen numbers of times and has also been charged under serious offences, all because he has pursued a cause very diligently and persistently for the last many years.

The cause is something very dear to him and it is that of forming an Association or appropriate forum for the Non-gazetted police officers of Uttar Pradesh. Recently his case had come in media when the High Court of Allahabad, while hearing to one of his many Writs filed so far there, not only admitted the writ but also asked all the concerned parties to respond within a given time frame. It was at this juncture that my wife Nutan also interviewed Mr Brijendra Yadav in which he came up with some very important points. I present this interview for a detailed exposition of facts as stated by Mr Yadav himself.(

As per Mr Yadav, he always believed that there shall be an appropriate forum/ association for the subordinate police personnel which could cater to their grievances and their problems. For this he tried to get an association registered but was told by the Registrar Office that such association needed approval of the State government. He alleges that he applied to the then DGP of Uttar Pradesh but some vested interests among the IPS officers came in his way and scuttled his attempts to get the association registered. He quotes many instances where senior police officers are violating the State-made rules and regulations for the betterment of the subordinate police personnel and feels that such situation needs some kind of Association which could cater to the needs of these people. A man of great commitment and strong will, he says that when he did not get the due approval, he went to the High Court more than once and only after the interference of the High Court, Allahabad, his association could get registered with the Registrar of Societies. As per his version, he had to pass through the same judicial process when the time for renewal of that Association came.

One more interesting thing he is pursuing these days is about the alleged misappropriation of funds by the senior officers of the Department over a long period. He claims that an organization named "The Committee for the Welfare of the members of the Police Force in UP" for the non-gazzeted police personnel was registered in 1961 but it only had IPS officers and their wives as its committee members. After getting registered, this society possibly did not get renewed even once while the laws say that each society must get renewed after five years. He also says that an amount of Rs. 25 per month per police person is being deducted from every police up to the rank of Inspector. With a police force of 3.5 lakh, this becomes 87 lakhs per month and 10.5 crore rupees per year. As per his claims, another scheme is there where Rs. 340 per person per year gets deducted. He has filed a Writ Petition in the Allahabad High Court where he has said that all this amount, which goes into many crore rupees, is being misappropriated and misused by the senior officers of the Indian Police service. His writ says that hardly any amount of all these deductions go to the welfare of the subordinate police personnel, and is being misused for purely arbitrary purposes by people having no authority to use it.

I personally don't have much information about all his claims except the fact that such deductions are certainly being made from the policemen. I don't know how this money is being used and whether his claims are true or false. But prima-facie two of his arguments do seem to make sense to me-

1. There seems to be need of police associations at all ranks so that there are proper forum which present the grievances and problems of the lower staff of the police department. This seems to be needed because times have come when lower level police personnel are more forthright and outspoken about their rights (which certainly is a positive feature) and an appropriate forum for their grievances would only be helpful for a better and more efficient functioning in the current scenario.

2. The way Sri Brijendra has said about there being no registered and legal organization and yet such a huge money being deducted from police personnel seems to be rather serious and somewhat improper.

Lastly I do feel that Sri Brijendra Yadav is a person of rare braveness and strength because only a person who has lots of courage and valor will stand so long and will fight for the rights of others despite personal sufferings. We need more people of such character everywhere in the society.
