High Court directions in case of Uttar Pradesh Hindi Sansthan


I, along with Nirmala Rai, Dr Pranav Kumar Mishra, Rajendra Pratap Singh and others filed a Writ Petition in Allahabad High Court, Lucknow bench regarding the awful conditions at Uttar Pradesh Hindi Sansthan and its callous attitude towards the various awards that need to be awarded by the Sansthan every year. Principal Secretary, Bhasha along with the President UP Hindi Sansthan and its Director were the respondents in the petition. Asok Pande is the advocate counsel for the petitioner.


The double bench of the High Court today ordered the State government to appoint a Acting President and Director in Hindi Sansthaan within one month and also to constitute the General body and Executive Committee of the Sansthan as soon as possible. The High Court also asked the government Counsel why awards have not been given as per their own Regulations. The next hearing shall take place after a month by which time the State government needs to present the compliance report in this regards.

The Writ said that the Hindi Sansthan was established for the proper development of Hindi language and literature and to help support in incorporating the emerging needs for modern science and technology. The Sansthan is regulated by its Regulations of 1998 which makes the Chief Minister as the ex-officio President of the Sansthan. As per Rule 10, there is a General Body and as per Rules 12 and 13 there are Executive Committee of the Sansthan. 


Again, the Sansthan has rules of awarding annual awards to senior and respected literatures for their exemplary and long-term contributions in Hindi and other regional languages. These range from Bharat Bharti award, Lohia award, Mahatma Gandhi award to Pravasi Bhartiya Hindi Bhushan etc.


As against these provisions, there is no General Body and Executive Committee functioning in Sansthan for long. Similarly after Dr Shambhu Nath's retirement as Acting President on 30/06/2009 and Dr Sudhakar Adib's transfer as Director on 26/04/2010, both these posts are lying vacant. Similarly there is a huge backlog in the annual awards given to deserving litterateurs. 2007 awards were the last one which were given as per the Regulations. Of the 2008 awards, only three awards were announced on 06/01/2011. In addition, the financial resources to the Sansthan are being reduced every year. While the Plan budget was Rs 16 lakh in 2007-08 and 2008-09, it got reduced to Rs. 10 lakh in 2009-10.


Based on these facts, the Writ requested that the Uttar Pradesh government be directed to form the General Body and Executive Committee within a given time-frame. Similarly, the posts of Acting President and Director be filled at the earliest. Prayer was also made that UP government announce all the awards for the years 2008, 2009 and 2010 as soon as possible.
