Writ to ban all kinds of pre-certification promos and some vulgar songs
A Writ petition has been filed today 23/12/2010 in the Allahabad High Court, Lucknow Bench by Dr Nutan Thakur against Twinkle Khanna, Shirish Kunder and Ronnie Screwvala, Producers of Tees Maar Khan, Farah Khan, Director of Tees Maar Khan, Arbaaz Khan, Malaika Arora Khan and Dhillin Mehta , Producers of Dabangg, Abhinav Kashyap, Director of Dabangg, Central Board of Film Certification (Censor Board) and Union of India through the Secretary of Information and Broadcasting. Asok Pandey is the advocate Counsel of the Petitioner.
The petition presents the fact that in film 'Dabangg' and Tees Maar Khan, as in almost all other cases of Hindi films and films of other languages, many indecent, immoral and vulgar songs, dialogues and visual representations start being shown and disseminated to general public through the means of channels of mass media like Televisions, radios and audio/ video cassettes even before the issue of certificate under the law of the land. This is completely against sections 3(1), 4, 5(A), 5(C) and 5(E) of the Cinematography Act 1952 because in many cases such songs, dances, scenes, dialogues etc do not get certificate later on but by that time it has been publicly exhibited to a very large extent. Hence the petitioner has requested the High Court to direct the Censor Board and Ministry of Information and Broadcasting to intervene and issue directives to the film-makers in all the languages and all other concerned bodies like the Television channels, radio stations, audio cassette and video cassette companies not to display anything (including songs, dances, dialogues, audio inputs, sequences, promos or other such materials of the film) before the Censor Board has issued the required Certificate to the respective films.
Dr Thakur has also prayed that in the songs Munni Badnam Hui and Sheila ki jawaani, there is the specific problem of use of such songs which are against decency, morality and public order and which can incite commitment of offences. This is against the provisions of section 5(B)(1) of the Cinematographer Act. She says that such unfortunate events have already started taking place where helpless and poor girls studying in schools and colleges, working women in all kinds of establishments, Institutions and organizations and even housewives are being teased, molested and sarcastically treated, more so when the name of the women/girls is Sheila/ Sheela/ Munni/ Muniya or other similar sounding ones. Hence she has requested to issue orders to immediately stop the public exhibition of these two songs. She has presented an example from Lahore, Munni, a mother of two in this Pakistani city, was harassed so much that she has shut her small shop. As an interim relief, the petitioner has requested ordering the respondents to stop the release of the Hindi film 'Tees Maar Khan' as long as the song 'Sheila ki jawaani' is not removed from the film and to stop the screening/ public exhibition of the Hindi film 'Dabangg' as long as the song 'Munni badnaam hui' is not removed from the film. The mater shall come for hearing on 03rd January 2011.
