COURT'S MANTRA: SATYAMEV JAYTE, NOT ALWAYS FOR JUDGES & LAWYERS.
Mahatma Gandhi, while practicing in South Africa as an advocate, refused to accept any false case and he could still had a lucrative practice.
In our country, a successful lawyer is he who can turn false case into a winning one.
If you throw shoe to a judge, you will be punished for 2 month's jail but if you express anguish on the inordinate delay of your case in harsh words before the judges, you get imprisonsed for 4 months!
This happened on 21st Dec. 2010 in Bombay High Court vide DNA news report dated 23-12-2010 captioned 'Lawyer gets jail for Tareeq pe Tareeq' Act.
The report said that N.B.Deshmukh, an advocate, frustrated against his client's case pending for 15 years had on October 10, 2008 told to a single judge while arguing "are we dogs? Don't treat us like animals. Are we running water (sic) in our nerves and others blood? Are we going to get justice in this life or not? Only (actor) Salman Khan's case gets quick disposal".
The judge issued him Suo Motu contempt notice to Deshmukh. When the matter came for final hearing before the bench of Justice Khanwilkar and Justice Bhangale, they termed Deshmukh's 'utterances as unruly and rowdy which clearly tend to lower the authority, majesty and dignity of the court'.
Deshmukh justtified his act by saying that this was an earnest criticism of the judiciary, and he was venting "true, real, purely natural feelings and the expressions (sic)." Deshmukh had twice refused to give an unconditional apology to the Court.
I am myself a senior citizen of 72 plus of age. I have filed 99 PILs (Public Interest Litigations). According to a Supreme Court rule and one of its judgements, the senior citizens and the PILs must get priority in hearing over other cases. Most of my PILs, I argue in person in the Bombay High Court and sometimes in Supreme Court also. I am not an advocate.
My some PILs are waiting to be heard for last 12-13 years. I also boil from within with anger but restrain muself. But my patience too has almost reached to the point of rupture.
A Judge or a division bench lists say 100 cases on a given day for hearing but many a day it happens that he could hardly reach to 20 cases. Thus handreds of lawyers and litigants are going back home empty handed. This is a nationwide seanario.
What a colossal loss of manpower and material resources counting such cycle running around thousands of judges across the country turning back lakhs of lawyers and litigants everyday!
What to do to remedy this malady?
As an humble beginning we few friends together in April 2008 founded a Trust named Forum For Fast Justice and launched a nationwide movement under the project of SAVE JUDICIARY-SAVE NATION.
We have organised a two days mega convention on judicial reforms during 22-23rd January, 2011 at Bharatiya Vidya Bhavan Campus, Andheri, Mumbai which will be inaugurated by Hon'ble Justice M.N.Venkatachaliah, former Chief Justice of India and the keynote address will be delivered by Dr.Veerappa Moily, Union Minister for Law and Justice. About 20 expert and activist speakers as well as 300 delegates assembling from all over the country, will try to find out the solution on this paramount problem through 8 sessions spread over two days.
