Bangalore: While Lokayukta Justice Shivaraj V Patil resigned immediately after he was charged with buying a residential plot in violation of rules, Karnataka information commissioner H N Krishna is still in his post despite police filing criminal charges against him in the Karnataka Administrative Service (KAS) recruitment scam.

Krishna, who holds a judge's position and delivers verdicts on RTI queries, appealed for anticipatory bail but it was rejected by the high court. A Vokkaliga, he has been accused of irregularities in awarding of marks and ranks to candidates of a p a r t i c u l a r community while making appoit – ments  to thousands of prestigious Group A and B posts. This happened when he was member and chairman of Karnataka Public Service Commission (KPSC) during examinations held in 1998, 1999 and 2004. He was also accused of recruiting persons who were ineligible on age and caste parameters. He allegedly took a signature from Alla Baksh, a meritorious candidate, and tried to prevent him from appearing for the personality test in December 2005.

Kaleel Ahmed and 61 others filed a writ petition in the high court, which directed the CID to investigate the matter.

The court recently appointed Justice Mohammed Anwar, a retired HC judge, to oversee the probe. Based on the report, police filed an FIR against Krishna and others on August 11 under Sections 417, 718, 465, 466, 468, 471, 506 and 120-B of the IPC.

VIEWPOINTS

There are serious allegations of bias and discrimination from officials and non officials of KPSC and the matter needs thorough investigation which is in public interest. Hence, anticipatory bail cannot be granted. — Justice H Billappa | OBSERVED WHILE REJECTING ANTICIPATORY BAIL PETITION

Krishna is a textbook and monumental example of brazenness. He should take a leaf out of Justice Shivaraj Patil's book and should exit gracefully to protect the dignity of the Information Commission. — C V Sudhindra | SENIOR ADVOCATE AND CONSTITUTIONAL EXPERT

I have not gone to office since the FIR was filed. I don't want to comment on this. — H N Krishna | INFORMATION COMMISSIONER, KARNATAKA

I'm looking into the issue (whether to continue with Krishna as information commissioner). I'll see the report and discuss the action with government. — H R Bhardwaj | GOVERNOR
