[rti4empowerment] Amitabh Thakur study leave case

Some of you might be remembering the study leave case of my husband Sri Amitabh Thakur, the 1992 batch IPS officer presently on extra-ordinary leave at IIM Lucknow for a Fellow Program in Management.

He got admitted in IIM Lucknow in April 2008. He then requested the State government on 30/04/2010 to grant him a study leave of 2 years from 10 June 2008 as per the provisions of the All India Services (Study Leave) Regulations 1960. He fulfilled the requirements mentioned under rule 3 of these Regulations. Yet he was intentionally denied the Study leave.  He then moved to Central Administrative Tribunal (CAT) and High Court, Lucknow Bench more than once. In the process, CAT gave an interim order and on its basis, the State government granted Sri Thakur extra-ordinary leave on 08/06/2009. In the order, the State government also said that the course was very useful for his service and yet denied him the Study leave.

Finally on 07/07/2010, CAT
ordered the respondents to reconsider the claim of the applicant for grant of study leave as per rules, overlooking earlier objections and pass a reasoned order as per rules within four weeks from the date of receipt of copy of the order. While Sri Thakur presented this order immediately before the State government, no order has been passed so far. Then he filed a Contempt Petition No 49 of 2010 in which CAT has today (13/01/2011) issued contempt notice against Sri Gopal Krishna Pillai, Union Home Secretary, Sri Kunwar Fateh Bahadur, Principal Secretary (Home), Uttar Pradesh and Sri Karamvir Singh, Director General of Police, UP. The next date has been fixed as 21/02/2011.

As I have already told you, meanwhile I am writing a book (both English and Hindi) on this entire case, which has been titled "Amitabh Thakur Study leave case." It is almost complete and is going through final stages.


If you can help me with a Publisher for both these languages, I shall feel grateful. The book shall be a true account of how the bureaucratic system works in Uttar Pradesh and shall be having many eye-opening revelations, where the basic dictum is-"show me the person and I shall show u the rule." There is a need for change in this situation.
