KARNATAKA STATE RTI ACTIVISTS FORUM NO. 54, 17TH CROSS, M C LAYOUT VIJAYANAGAR, BANGALORE PRESS RELEASE A Dharna in protest against appointment of retired IAS & IPS Officers to the State Information Commission will be held on 12th January 2011 at 11 AM at Town Hall, JC Road , Bangalore . RTI Activists, Prominent Citizens and Leaders of various organizations working for the implementation of RTI Act are participating in the Dharna. In the meeting held on 8th January 2011 under the Chairmanship of Mr. B S Yedyurappa, Chief Minister with Mr. Siddaramaiah, Leader of Opposition, Karnataka Legislative Assembly and Mr. B V Acharya, Minster for Medical Education as members decided to appoint the following persons for the Karnataka Information Commission: 1. Mr.A K M Nayak, Retired IAS Officer as State Chief Information Commissioner. 2. Mr. D Thangaraj, Retired IAS Officer as Informaion Commissioner 3. Mr. M R Poojar, Reitred IPS Officer as Information Commissioner. 4. Mr. Rama Naik, Advocate from Shimoga as Information Commissioner 5. Dr. Shekar D Sajjanar, President, Rotary Club, Gadag as Information Commissioner, Recently a few IAS Officers met the Chief Minister and submitted a representation requesting him to appoint only IAS Officers for the Post of Chief Information Commissioner and also for the other vacant posts of Information Commissioners. They vehemently opposed appointment of non IAS Officers for the post of Information Commissioners. Bowing to the pressure of IAS Officers lobby the committee has recommended for appointment of two IAS and one IPS officer to the State Information Commission. Mr. A K M Nayak during his service had opposed implementation of Karnataka Transparency in Public Procurement Act as well as Karnataka Right to Information Act, 2002. The recommendations made by the Committee for appointment of above persons to the State Information Commission is contrary to the Provisions of the RTI Act as none of them had neither experience nor requisite knowledge of Right to Information Act. We are also not aware of their contribution for implementation of RTI Act. Recently The Supreme Court has sent a notice to the Department of Personnel and Training asking for formulation of guidelines for appointment of Information Commissioners. Therefore it is better to wait for finalization of guidelines by the Central Government. Appointment of ineligible persons as Information Commissioners is detrimental for implementation of the Act in its true spirit. Therefore, We, the members of Civil Society strongly protest appointment of above persons to the State Information Commission. We request immediate intervention of the Hon'ble Governor of Karnataka and withhold appointment of above persons to the State Information Commission in the public interest.
