[rti4empowerment] Re: [Janshakti] Anna should put up new demands for welfare of Nation,& nationals.

 



Agree with Vijendra on all the first 5 points but on the 6th there is no need to increase the number of ICs but their compensation should be based on a satisfaction certificate from the complainants/appellants.

The tasks of the ICs are very very simple and straight forward and even a munsif's job is many times more difficult than an IC because s/he has to deal with a plethora of laws whereas the IC has to deal with only the RTI Act. S/he should not take more than 5 minutes to dispose off a case. In fact they allot only 15 minutes for a hearing, as it is. But still how many cases do they dispose off in one day? Most of them are worse than the anti-social, anti-national elements we hear of.

To elaborate further. The task of an IC involves finding answer to the following questions and taking corresponding actions:

1. Is the info sought exempted from disclosure? (or, is the info sought from a public authority that is exempted from the purview of the Act?)
2. If not, is there any legally valid reason for not providing he info in time?
3. If not, what is the delay?
4. Issue directions to the PIO to provide the info sought and also intimate reason(s) why the penalty mandated under Sec 20 should not be imposed.
5. Ensure that info sought is provided and impose the mandated penalty.
6. Direct the superior officer of the PIO to confirm that the penalty imposed has been recovered and credited into the appropriate account of the govt within, say, 30 days.
7. If such confirmation is not received direct the approppriate authority to take administrative action against the defaulting officer.

It may please be noted that there is no need for summoning the complainant or appellant of any hearing and harassing him/her. That it is mandatory to impose penalty even if all the info sought has been provided but there has been delay in providing them.

1)-Electoral Reforms
2)-Setting aside all discretionary powers of all public servants.
3)-Compulsory moral education in schools , colleges upto postgraduate level.
4)Police Reforms
5)- Corporate companies to be under RTI Act.
6) -RTI Act implementation to be improved a lot by increasing the number of Information Commissioners & their quality.
