[rti4empowerment] Two poems on Bhopal gas tragedy

 

Friends,

In the course of my efforts to make a feature film on Bhopal gas tragedy, I have been reading a lot of related materials and documents.

I present a bye-product of the same, two poems related with Bhopal gas tragedy. These are only a formative view of mine and not the final one.

Again request for all possible support in the making of the feature film on Bhopal, presently by suggesting all reading materials and other documents/ concerned persons.

Bhopal

I have been going through the vast literature,
related with the tragedy that was Bhopal,
I had the opportunity to read,
...the plethora of Court judgements,
including those from the Supreme Court,
the High Court, the District Courts,
also that of Justic Keenan from USA,
each of these judgements are exactly what they should be,
they are justice done for the cause,
each of the decisions are long and detailed,
they delve deep down into the problem,
they explore the legalities of the issue,
they separate the grain from the chaff,
the judgements are fantastic and brilliant,
the one by the District Judge Bhopal,
who declares an interim relief,
also that of the High Court at Bhopal,
which reduces the interim relief by hundred crores,
again the same can be said for the Supreme Court,
it settles the matter once and for all,
it orders the Union Carbide to pay,
it all asks all the liabilities ti end,
whether it is the Civil or the criminal one,
Before this the order of Justic Keenan,
who analyzes the American law,
and declares that US is not the right place,
the case shall go to the Indian Courts,
and why to forget the Government decision,
to get passed the Bhopal Liability Act,
taking up all the responsibilities of the sufferers,
filing and fighting litigation in Courts,
and not charging any money for that.
So many decisions afterward,
whether rescinding the order about Criminal liability,
or limiting the Criminal liability to a few criminal sections,
or the one ordered on the Review petition,
or the one by the Chief Judicial Magistrate,
ordering two years Imprisonment to eight accused,
the ninth one having died during the process,
It is great going through all these documents,
and understanding the niceties of laws,
and that of Acts and legal perspectives,
yes, there is so much to learn and understand.

I am trying to find the answers
to some of the queries I have in mind,
yet, one answer that I have clearly got
is that I have missed the bus,
the moment I was not born in America,
because all said and done,
about Human Rights and dignity of mankind,
about the Universal Declaration of Human Rights,
and about a vast number of UN Covenants,
the basic fact is that
East is East and West is West,
and never the twain shall dare to think,
that they shall ever meet,
on a platform of equality,
and hence if you lived in India,
you need to die as an Indian,
and so even after death you remain,
an Indian in the end,
whose life needed to be compensated,
at a calibrated scale,
that was to be proportional,
to the GDP of the Country,
vis-a-vis that of America,
and hence that was the hard fact,
I shall always remember.

Anderson and Mahindra

We all know that
the prime accused in Bhopal gas case
is none other than Anderson,
...Warren Martin Anderson for full,
assisted primarily by Keshub Mahindra,
one of them now convicted
for two years imprisonment
while the other being a fugitive,
apparently hiding somewhere in USA.

Interesting it is to know
and quite ironical too,
that the same Anderson
was son of a Swedish immigrant,
who came to America to make it big,
he started as lowly as a salesman,
and had hardly any fanciful education,
less any high-flying background,
except the grit, determination and ambition,
to prove himself in life,
which he did for sure,
when he became the Chairman of Union Carbide,
the third largest Chemical company in the world,
and till this time had always said,
he believed in ethics and morals,
and honesty and diligence.

No different is the case of Mahindra,
about whom the company says
that he is a philanthropist
who redefined corporate governance
by effectively channeling funds
into the social sector.
His profile claims that
he has been involved all through
in building ethical corporate organizations in India.

Facts about both of them
must have been fully true,
but somehow when the time came,
to test them in the crucial hours,
possibly they proved to have
the ordinary feet of clay,
or is that we are all the same,
ordinary human mortals,
with high sounding words
