| आज इलाहाबाद उच्च न्यायालय के लखनऊ खंडपीठ में आईपीएस अधिकारी और आईआईएम लखनऊ के फेलो अमिताभ ठाकुर तथा सामाजिक कार्यकर्त्री डॉ नूतन ठाकुर द्वारा आईआईएम के लिए ली जाने वाली कैट परीक्षा अंग्रेजी के अलावा हिंदी तथा अन्य क्षेत्रीय भाषाओं में भी कराये जाने हेतु एक रिट याचिका दायर की गयी. याची के अधिवक्ता अशोक पाण्डेय हैं. यह केस दिनांक 04/03/2011 शुक्रवार को सुनवाई के लिए आएगी. मानव संसाधन विकास मंत्रालय, उच्च शिक्षा विभाग के साथ आईआईएम अहमदाबाद, आईआईएम बैंगलोर, आईआईएम कलकत्ता तथा आईआईएम लखनऊ इसमें प्रतिवादी बनाए गए हैं.
इस रिट याचिका में कहा गया है कि सभी आईआईएम के निदेशकों ने आम सहमति से एक निदेशक फोरम बनाया और इसकी सामूहिक स्वीकृति से पोस्ट ग्रेजुएट प्रोग्राम इन मैनेजमेंट और फेलो प्रोग्राम इन मैनेजमेंट में चयन हेतु एक कॉमन एडमिशन टेस्ट (कैट) परीक्षा की व्यवस्था की गयी. कैट परीक्षा में एक अभ्यर्थी की आंकिक, वर्बल तथा तार्किक/डाटा इंटरप्रेटेशन क्षमता टेस्ट की जाती है.
याचीगण का कहना है कि यह व्यवस्था ऐसी है जिसके कारण हिंदी तथा अन्य क्षेत्रीय भाषाओं में बीए,एमए आदि में अध्ययन करने वाले लाखों छात्र-छात्राओं के साथ भेद-भाव की स्थिति बनी हुई है. याचीगण ने इन परीक्षाओं से तुलना हेतु देश की दो अन्य प्रतिष्ठित और समकक्ष परीक्षाओं आईआईटीजेईई तथा सिविल सेवा परीक्षा का उल्लेख किया है. आज आईआईटीजेईई परीक्षा हिंदी और अंग्रेजी दोनों भाषाओं में ली जा रही है, जबकि विविल सेवा परीक्षा में संविधान के आठवें अनुच्छेद की सभी भाषायों में परीक्षा ली जाती है.
याचीगण का कहना है कि मानव संसाधन विकास मंत्रालय के अनुसार आईआईएम का उद्देश्य "भारतीय अर्थव्यवस्था के प्रत्येक क्षेत्र हेतु उच्च स्तरीय मैनेजमेंट शिक्षा तथा ट्रेनिंग, रिसर्च तथा कंसल्टेंसी सेवा प्रदान करना है." साथ ही यह भी कहना है कि "देश के नॉन-कॉर्पोरेट तथा अल्प-नियंत्रित क्षेत्रों के लिए रिसर्च करना' आईआईएम के उद्देश्य हैं. ऐसे में मात्र अंग्रेजी भाषा में कैट परीक्षा लेना न सिर्फ हिंदी तथा क्षेत्रीय भाषाभाषी लोगों के लिए भेदभावपूर्ण है बल्कि आईआईएम के मूल उद्देश्यों को भी पराजित करता है.
इन सभी तथ्यों के आधार पर अमिताभ तथा नूतन ने उच्च न्यायालय से यह निवेदन किया है कि कैट की परीक्षा अंग्रेजी के अलावा हिंदी तथा अन्य क्षेत्रीय भाषाओं में भी कराई जाए. साथ ही यह भी निवेदन किया है कि कैट के बाद की आईआईएम में ली जाने वाली इंटरव्यू, जीडी, निबंध जैसी परीक्षाएं भी अंग्रेजी के अतिरिक्त हिंदी में कराने के आदेश निर्गत किये जाएँ
A Writ for holding CAT examinations for entrance to IIMs in Hindi and other regional languages has been filed today in Allahabad High Court, Lucknow Bench by IPS officer and Fellow at IIM Lucknow Amitabh Thakur and social activist Dr Nutan Thakur. Asok Pande is the counsel for the petitioners. The case shall come for hearing on 04/03/2011 Friday.
The writ says that IIMs, though an informal IIM Director's Forum began the Common Admission Test (CAT) for intake of students in Post-graduate Diploma Programmes in Management and subsequently in fellowship Programmes in Management. CAT consists of questions that evaluate a candidate's quantitative, verbal, and logical & data interpretation abilities. These tests are conducted only in English language.
The petitioners say that this arrangement has clearly adverse and discriminatory effect on lakhs of candidates who have Hindi or other regional languages as their medium of instruction till the Bachelor's and Master's degree. They have presented examples of two other equally prestigious examinations of National repute- the IITJEE and Civil Service Examinations. In IITJEE today the medium of examination is both Hindi and English, while the Mains examination and even the Interview of Civil Services has all the languages specified in the Eight schedule as their medium of examination. The petitioners say that Ministry of HRD says that IIMs have been established with the "objectives of imparting high quality management education and training, conducting research and providing consultancy services in the field of management to various sectors of the Indian economy". Also, these Institutions are also supposed to "conduct research to cater to the needs of non-corporate and under-managed sectors." In such circumstances and with the given facts, taking of CAT examination only in English is clearly discriminatory for students having their education in Hindi and other regional languages. At the same time, it also defeats the basic purpose of establishing these IIMs.
Based on these facts, Amitabh and Nutan have requested the High Court to direct the Respondents to conduct the CAT examination in Hindi Medium and other major regional languages as well. They have also requested that the later part of the IIM entrance test, like the Group Discussion, Essay and the Interview be also conducted in Hindi as well, other than in English as being done presently
