India proposed to become a Theocratic State ! :

( I understand that there is rampant prevailing corruption, but then, we cannot sit and rest like that without doing something about a problem, so let us experiment & make India a Theocratic State, Fantastic !!!!!, kindly read further .....)

> Humble Request:

International Research Paper requested to prove the Efficacy of the proposed Janlokpal / Lokpal a Theocratic concept.

There are more than 150 countries in the world which follow democracy.

All the Democratic countries across the world are following an age old well established structure of Democracy:

You may download constitution of any democratic country in the world from internet with the help of Google, and you will find that they have an exactly identical (you may find it surprising but it is true) structure of a democratic model of governance, with three primary organs of a State, namely Legislature, Executive & Judiciary.


Ombudsman too is an International concept renamed in India as Lokpal:

An ombudsman (Lokpal) is an international concept whereby, an official, usually appointed by the government or by parliament but with a significant degree of independence, who is charged with representing the interests of the public by investigating and addressing complaints reported by individuals.


Now, with exactly the same democratic structure of governance in place across the world, some countries rank low on corruption perception index, whereas some others rank high on CP index (for details on ranking you can check Transparency International website).


Questions:
  • How did the countries which rank comparatively high on Corruption Perception Index, achieve that? Did they achieve it through an institution called Ombudsman with policing powers, over and above any / all the primary organs of a democratic govt?
  • It is claimed that if proposed Lokpal were introduced in a particular format, then the corruption will get reduced by 60 to 65 % ! What is the scientific basis on which these figures have been quoted?
  • Which Ombudsman in a democratic country in the world has the kind of structure that has been proposed for Janlokpal / Lokpal?

Further Questions:

  • Is there any international research paper on the subject which proves the efficacy of the concept? or is it a proposed hypothesis?
  • Are we experimenting with our nation by suggesting a Policing Ombudsman over a Govt  without understanding its implications on a democratic form of governance? 
(Please understand that every institution, irrespective of being independent & autonomous, is ultimately made up of human beings > if power corrupts human beings, in an existing institution > and if the new institution is also going to be conferred with power > then the suggestion runs into a possible looping concept e.g. look at the following independent & autonomous institutional set-up -  Lower Court > High Court > Supreme Court > Corruption is rampant despite independent & autonomous judicial system, and therefore let us now have a > Supremest Court > And then Supremest Court Version II > and so on and so forth ?

But then, we cannot sit and rest like that without doing something about a problem, so let us make India a Theocratic State, Fantastic ! )



Irony of a Provision in the proposed Concept - A frivolous & vexatious provision itself to penalize frivolous & vexatious complainant:

Which Ombudsman (JanLokpal / Lokpal) in the World has a provision to penalize a Complainant citizen on the ground that he is a frivolous & vexatious complainant, that too at the entry level itself without conducting proper investigations? (i.e. such a provision in itself is a frivolous & vexatious one in the first place independent of a whether a complainant citizen is frivolous & vexatious)

And so, Lokpal can penalize (fine + jail) people working for the Govt. on one hand and Citizens ALSO on the other hand ! Wah bhai Wah, a complete Theocratic State !

Irony of the concept itself - Even the most Honest persons cannot function in such a system:

I believe that irony of the proposed policing concept is such that in a bid to curb corruption, even the most honest people in a Govt. will not be able to function; which honest human being can function with a Policing Power sitting on his head all the time, especially, tapping and intercepting into all his communications e.g. telephones, e-mails. etc.?


Finally, has the concept, been proposed after a detailed international research or is it an experiment with the entire nation:

I understand that our country is facing rampant corruption, I also understand that democratic form of governance has its own pros and cons, but then if someone intends to propose an alternative new form of governance for my country, then, given that democracy is already practiced in over 150 countries across the world, either this new concept has to be either an internationally well researched and a scientifically proven one adapted to Indian conditions or it has to be proposed with a disclaimer that it is an experimental one.
