Re: [rti4empowerment] Re: Voters explore the ‘right to reject ’ TNN | Jan 5, 2012, 05.38AM IST

Thank you Mr. Bhanot for pointing this out
It just proves that 49(O) is nothing more than an impotent attempt
at mollifying the voter, besides providing info on who voted to use this section.

NOTA is the way to go

I have myself used this right under Rule 49-O and there is noting like as mentioned in the Post No. 52 above.

First of all exercising $(-O right is not a Right to Reject. It is merely one is abstaining from voting.

Number 2 - The right exercised under 49-O is not a confidential franchise. It is all open and for every body to see and access. I have applied under RTI Act 2005 for the copies for the Form 17-A, where it was recorded by the presiding Officer that I am exercising my right under Section 49-O.

Thirdly - Voter does not have to give a reason to exercise his right under Rule 49-O except to declare the he wishes to do so.

And lastly, it is not like it that if more than 50% 49-O voting is done, constituency go for a repoll. However, it may result in the forfeiture of security deposit of the candidate(s) who are polled less then the threshold number of votes.

Please see my next post as to how did I exercised my 49-O right on the last election held in Chandigarh on 17 December 2011.
