The Supreme Court direction, order, is clear, no hawkers, legal or illegal, is permitted within 100 m of educational institutions, etc., 150 metres from railway stations, markets, etc.

The appeal of thirty years business is false.

They were illegal in 1985, and they are illegal now.

The Supreme Court order is clear, wonder how then, the respondents are going to the High Court to get relief from Supreme Court orders


No doubt everyone has a right to livelihood, but through illegal means, is the point.

Does that mean a serial car thief can keep stealing cars for his livelihood, etc., because he was not caught for years.

No one stops them from setting up legal stalls in hawking zones as per the laws.

There are Aarey dairy booths on the foot path, dealing in stationery and photo copying for the students, and preparing South Indian snacks inside and outside these.

Are these milk products made by Aarey, by any stretch of imagination.

The solution is to follow the law, like all law abiding Citizens.

The solution is also to make them hawk in the hawkers plaza  and market made for them at various places.

Another canard is that the illegal hawkers claim that students prefer the fare, ie food,  the hawkers offer.

This is again a fraud.

Who are these students who are seen more on the foot paths of the roads than in class.

Are they in college for the food or for their studies, and are they the final say as to where illegal hawkers can hawk


If it goes on like this, why not allow any body and every body on the roads, abolish the Mumbai Municipal Act, 1888, have complete autonomy from the Union of India, and call it the Free City of Mumbai where its full freedom with no laws applicable in civic matters, all hawkers permitted, all FAR / FSI violations will no more be violations, traffic rules to be thrown into the Arabian Sea, traffic signals to be sold in Chor Bazaar scrap market, etc.

Given the scene in the Lok Sabha today, 2011 DEC 22, and most of the time, it is near anarchy in many parts of India already.

Don't rob hawkers of their livelihood: Bombay High Court

The Bombay High Court on Wednesday stated that there has to be a balance between beautification of city footpaths and evicting illegal hawkers, whose livelihood is dependent on the business they carry out.

The observation was made during a hearing of a petition filed by Vile Parle Kelawani Mandal, which has sought directions to the corporation for removal of hawkers outside its institutions.

A division bench comprising Justice PB Majmudar and Justice MR Bhatkar said, "Judicial pronouncement is not a solution in all cases. Why don't you make some arrangement with hawkers' association to work out a way in which their livelihood is not affected and they don't even put up their stalls in the area? We have to take a human approach to the problem, as we don't want people to be robbed of their livelihood and turn to crime."

An association of the area hawkers also intervened in the petition and their counsel, M Vashi, argued, "The corporation has due to the court orders cancelled the licences of those hawkers who have been carrying out their businesses for the last 30 years."

The court allowed the hawkers to intervene and directed the petitioners to file a reply to the claims. The civic body filed a detailed affidavit explaining the action taken by them. BMC's counsel said, "We have demolished six of the illegal stalls and as per court order, we have not taken any action against those stalls that have licences or have appealed in civil courts."
