[rti4empowerment] Refusal of Police Association challenged

 

Friends,

I have today filed a Writ Petition in the Hon'ble Lucknow Bench of the Allahabad High Court as regards a Government Order dated 15 October 2013 whereby permission for formation of a Unified Police Association was refused and IPS/PPS Association were stated to be legally permissible.

The Petition says that the State Government has declared that IPS and PPS officers are not "Police Officers" within the meaning of Police Forces (Restriction of Rights) Act and hence they don't need permission to form their Association, while as per the Police Act 1861 and Para 397 of UP Police Regulations IPS and PPS officers are police officers.

On the above basis, the Petition has challenged the existence of IPS and PPS Associations, while demanding for formation of a Unified UP Police Association.

To me this is an issue related with Right to Equality as per the Constitutional provisions.
