[rti4empowerment] Aarushi verdict historic, need justice for 3 Nepalese

Aarushi verdict historic, need justice for 3 Nepalese

Legally I find the CBI Court order in Aarushi case as being historic and great because the way the murder took place, the evidences that came from the beginning and the first CBI Closure report itself said that none other than the Talwars could have committed this murder, this sentence is true justice towards Aarushi and Hemraj.

Legally this does not seem to come in the category of rarest of the rare and life imprisonment seems to be perfectly appropriate.

I went through the entire judgement delivered by Judge Sri Shyam Lal from Special Court, CBI, Ghaziabad and found it to be truly wonderful. I congratulate and bow before the knowledge, wisdom, depth and sincerity of purpose of the Judge. It is an order worth reading. It is definitely the victory of justice in true sense of the word.

The order on Aarushi case proves that the defence lawyer Sri Tanvir Ahmad Mir was truly sincere towards his cause and made the best possible efforts though as the CBI Court said-"prosecution has placed a clinching wealth of circumstances from which the guilt of both the accused has been made out to the extent human instruments can apprehend."

I, along with wife Nutan had yesterday filed a petition before Chairman, National Human Rights Commission (NHRC) praying to seek adequate compensation for the unwarranted arrest of three poor and helpless Nepalese Krishna, Rajkumar and Vijay Mondal by CBI in an extremely hurried manner in Aarushi case.

The petition also asks for fixing of criminal and administrative responsibility of CBI officers found responsible for these unwarranted and improper arrests.

We have made these prayers based on Supreme Court orders in Joginder Singh vs State of UP and Neelbati Behera vs State of Orissa. As per petitioners, CBI had made these arrests w
ithin days of taking the investigation, who had to be later granted bail due to lack of evidence.
Today while going through the order, I specifically found written-"After completing the investigation Mr. Kaul reached to the conclusion that these twin murders were committed by the accused persons and not by Krishna, Rajkumar and Vijay Mandal or any other outsider. However, on interventions of super sleuths of C.B.I. closure report was laid by Mr. Kaul in the court." The question that naturally arises is-"Who are these Super sleuths and why did they do so?" The question also is-"When will the three poor Nepalese Sri(s) Krishna, Rajkumar and Vijay Manda get justice?"

It is these two questions to which our petition wants to find an answer.
Previously Nutan had raised this matter before Allahabad High Court, Lucknow Bench which had directed her to go before the Allahabad Bench.
