Sub : Urgent clarification required to save a helpless old man and our nation
from terrorism - reg.
A poor deaf old man is put into enormous sufferings by the corrupt officials in Tamil
Nadu. I enclose copy of a judgement delivered by a learned magistrate.
In the last para of the judgement the learned magistrate says that
“Letter has been sent from the remitting bank that money had inadvertently sent and the
amount should be repatriated. On 28.1.04, 1,20,000 Euros which is equivalent to
Rs. 69,35,200/- has been remitted to the State Bank of Indian of account of P.K. Narayanan and
on 16.2.04, the amount of Rs. 68,24,000/- has been transferred to Sundry Deposit Account.
Admittedly the amount has been sent by Aquarelle from Mirabaud And Cie Banquiers
to the account of P.K. Narayanan. Ex. P8, P9, P10, P11, P12 clearly prove that the amount
has been sent from the account of Aquarelle and Ex. P8, P9, P10, P11, P12 clearly prove
that Mr. Patrick Turion has account in the name of Aquarelle in Mirabaud And Cie
Banquiers. Hence, the amount of Rs. 68,24,000/- as shown in Ex. P10 lying in the Sundry
Deposit Account is ordered to be recredited to the account of Aquarelle by the State Bank of
India, after getting necessary permission from the Reserve Bank of India. The State Bank of
India is requested to satisfy itself with regard to the source of funds and bonafide and also
ensure compliance with Fema regulations. This order to come to effect after appeal time is
over.”

The magistrate has heavily depended on some certified papers and come to the
conclusion that the complainant in crime number 211/2004 of Triplicane police station, chennai
city Mr. Patrick Turion and the sender of the amount Aquarelle are one and same, and on the
strength of it convicted the innocent old man.
The Learned Sessions Judge also confirmed the conviction.
Please clarify with the French Government whether an individual can have two
bank accounts in two different names in their country.
In our country after the terrorist attack an America the banks ask for two documents
(KYC - Know your Customer) from an individual who wants to open an account, identity proof
and residential proof and then only allows the individual to open the account. The banks are very
strict in this. If an individual wants a open a account in another name, say a pet name that name
should have been included in the concerned individuals passport.
But in this case the passport of the complainant was not marked as a document to
prove that he is having a pet name. With out verifying this basic and all important and serious
factor, the Learned Magistrate, the police, the bank officials and the advocates conducted the
trial which ended in the conviction of the unfortunate man. The learned sessions judge has also
failed to notice this basic flaw.
Now the matter is pending with the Madras High Court in Crl..R.C 688 of 2011. There
are lot of holes in the entire investigation and trial. The poor old man, who is a bachelor, deaf and
70 years of age is mentally and physically suffering because of the indifferent system of our
country.
I request your immediate action in this regard to save the unfortunate man and to save
our nation from terrorism. Please get in touch with the french government and get it clarified
whether an individual can have two accounts in different names and send money to India using
the pet name.

a. to quash the FIR as it is illegal. The complainant at the time of preferring the complaint
never claimed that the money was sent by an account which was in the name of
Aquarelle.
b. to forward the 3 letters which were admittedly written by the complainant to the police
officers on 7th Februay, 2004, to the State Vigilence Department as it reveals
corruption. The Magistrate as well as the Sessions Judge failed to take this action.
2 . The French Consulate, 40 College Road, Chennai - 600 006 to reveal whether an individual
can have bank accounts in different names and to findout whether Mr. Pattrick Turion is
having an account in the name of Aquarelle as claimed by him.
3. The Branch Manager, SBI, Mount Road, Chennai - 2.
4. The Regional Director, Reserve Bank of India, Fort Glacis,Rajaji Salai, Chennai -
600 001, to initiate suitable action against State Bank of India which failed in informing
various Central Agencies regarding the huge remittance from a Foreign Country.
5. The Deputy Commissioner of Police, Triplicane.
6. The Director General of Police, Tamilnadu, Chennai - 4, to initiate suitable action against
the erred officials who failed to verify the source of the amount remitted into the account
from terrorism angle.
7. The Home Secretary, Government of Tamilnadu.
8. The Superindent of Police, CBI / ACB, Chennai - 6 to investigate the dubious role played
by the State Bank Officials in this case.
