Friends,

I and wife Nutan filed a Writ Petition No 9359/2012 in Hon'ble Allahabad High Court, Lucknow Bench regarding non-compliance of rules by various Service providers like Google, Facebook, Twitter, Yahoo etc. Today the bench of Justice Uma Nath Singh and Justice V K Dixit directed Department of Information Technology and Department of Technology, Government of India to ensure that these Service providers fully comply with Rules 3 and 11 of the Information Technology (Intermediaries guidelines) Rules, 2011.

Rule 3 asks the service providers to specify the matters which cannot be put or transmitted through them. Rule 11 asks them to publish the name of the Grievance Officer and his contact details on their website.

We had previously filed a Petition in the same matter where on 09 May 2012 Justice Devi Prasad Singh and Justice Saeed Uz-zaman Siddiqui had ordered for complete compliance of these Rules. We filed this second petition because this order was not complied by the service providers.

If the service providers start following these Rules, it will be a big relief for Internet users as they will have a ready mechanism to present their grievances and to object to offensive materials.

Regards,
