[rti4empowerment] complaint on MPs tax evasion

Sir,
              Sub:  MPs of both houses of Parliament- under reporting
of income- evasion of payment  of tax in full –action to collect
prescribed income tax- reg.
             Ref:  Our previous RTI application from V.Gopalakrishnan
                                                             -----
                  We have sought for certain information under RTI Act
about the income tax returns filed by some of the Members of
Parliament.

                  The CPIO of the Public Authority of Income Tax
Department, ACIT, circle 40(1), New Delhi has refused to supply the
information stating illegal and unmaintainable reason. It is also seen
from the Parliament Bulletin of February 2010 that, since the salary
and allowances are taxed under the head "income from other source", no
TDS has been given effect to and the members have to discharge their
tax liability by paying advance tax.The payments are directly made to
the MPs by the Parliament Secretariat. Hence the appropriateness of
the
stand taken in the bulletin, need to be studied and decision taken.
                  Apart from the above, the following MPs have shown
their income as" NIL " in the affidavit filed before the Election
Commission.
            1.       Sri.K.V. Thangabalu, Tamilnadu
            2.       Sri.K.V. Ramalingam, Tamilnadu
            3.       Sri.Kumar Dilip Singh Judev,  Chattisgarh
the following MPs have 'under reported' their income in the affidavit
filed before the Election Commission.
             1.       Sri.S. Thirunavukkarasar, Tamilnadu
            2.       Sri.S.K. Karvendhan,  Tamilnadu
              3.       Sri.T.R. Balu,  Tamilnadu
              4.       Sri.A.V. Bellarmin, Tamilnadu

On further investigation and analysis, it has come to light that most
of the MPs have under reported their income, much less than the actual
income of around Rs. 11 lakhs per annum. Such details are available in
the affidavit filed by them, as is found in the web site of Election
Commission.

                   It reveals that the MPs are not making the due
payment of income tax commensurate to their income.

                   Hence it is requested to take effective steps to
recover the unpaid tax amount for the past several years, which is
arising out of unrealistic reporting of their income.
