[rti4empowerment] PIL for control of certain top-selling bulk and generic drugs [1 Attachment]

My wife Nutan has filed Public Interest Litigation No 7596/2012 in Allahabad High Court, Lucknow Bench to put a control over the excessive prices of certain bulk and generic drugs as found in a study conducted by Corporate Affairs Ministry, Government of India.

She has said in her PIL that the Corporate Affairs Ministry conducted suo-motu stud
y of top ranking formulations and four top-selling Generic drugs Amlodipne, Metformin, Ciprofloxacine and Azithromycin produced by top selling pharmaceutical companies of India like Ranbaxy Global, Dr Reddy's lab, Wyeth, Glaxo smithkilne, Pfizer, Zydus Cadila etc. The study found that the profit margin ranges from 203% to 1123%. Corporate Affairs Ministry had written to Chemical and Fertilizer Ministry on 12 June 2012 to take necessary steps to control the exorbitant prices of these drugs. All these drugs are Non scheduled drugs where the Central Government cannot directly control the prices under the Drug Prices Control Order like that of Scheduled drugs. But the Central Government can control the prices under Order 5 and 10 of the Control Order if it is found that the prices are being fixed at exorbitantly high levels.

She has said in the PIL that a profit margin of 1000% is certainly extremely high and improper and hence she has prayed before the High Court to direct the Central Government authority, the National Pharmaceutical Pricing Authority to fix the drug prices to reasonable levels. The PIL shall be heard tomorrow.
