Subject- As regards allegations made by social activist Sri Arvind Kejriwal in Coal mining scam being investigated by the CBI

The petitioner
Amitabh Thakur, address- 5/426, Viram Khand, Gomti Nagar, Lucknow-226010, phone number- 94155-34526 is a Government servant by profession (an officer of the Indian Police Service, UP Cadre) but he is presenting this petition in his individual capacity as a citizen of this Nation.
1. That this petition is as regards a particular aspect related with the Coal Mining Scam or Coalgate (as it has been named by the Indian Media) in which the Central Vigilance Commission (CVC, for short) based on a complaint of two Bharatiya Janata Party Member of Parliament Sri Prakash Javadekar and Sri Hansraj Ahir had directed an enquiry by the Central Bureau of Investigation (CBI, for short). In the course of the enquiry, the CBI has so far registered five criminal cases in this matter and searches/raids were conducted at 30 locations in 11 cities including Nagpur, Kolkata, Bhilai, Yavatmal, Raipur, Dhanbad, Ranchi, Hyderabad, Mumbai, Delhi (NCR) etc on 04/09/2012.
2. That exactly two days after this raid, Sri Arvind Kejriwal, an eminent and well-known social activist working for greater transparency in Government, made certain extremely crucial statements as regards these raids by the CBI. Through the online social networking service Twitter, Sri Kejriwal made the following tweets which are of great relevance as regards this entire coal scam in general and the CBI raids on 04/09/2012 in particular. Firstly he said- "CBI raids on coal companies an eyewash?" and followed it by another tweet/ statement- "Just recd mail from an officer in one of raided cos. They were informed 2 days in advance abt raids and were asked to remove all material". (Just received mail from an officer in one of raided companies. 3. That the India Against Corruption (IAC, for short), an organization that Sri Kejriwal is associated with later claimed: "We have come to know the companies which were raided on Tuesday in connection with the coal mines allotment scam were tipped off in advance so that they could destroy all evidence against them. This has been revealed to us by a whistleblower and we have consciously decided to make it public while taking full responsibility of our statement. 4. That it needs to be noted that Sri Kejriwal is an eminent social activist and is well-known globally for his anti-corruption crusades, including his efforts for the promulgation of the Lokpal Act. Hence a statement coming from him has made very strong impact all through. These statements are of huge importance because they are related with the integrity and basic reputation of CBI, the premier investigating agency of our country. The above allegations made by Sri Kejriwal as regards the CBI raids are something which cannot be ignored.
5. That the petitioner, naturally being ignorant of the facts, cannot and shall not comment on the veracity of the facts as stated by Sri Kejriwal and as denied by the CBI. At the same time, the petitioner, having remained in an investigating organization for long, understands that one statement of this kind, coming from a person who commands respect among his large number of followers as regards another agency that is well respected and well-known for its impeccable integrity and sterling performance, has the potential of making a deep and perpetual impact.
6. That this statement has already taken its toll and the Indian Media has already started discussing this aspect, where Special Programs are being relayed on News Channels as regards the allegations made by Sri Arvind Kejriwal and IAC and their veracity.
7. That whether these statements of Sri Kejriwal and IAC are true or false, either way this fact needs to be verified and known to one and all because this a matter that concerns the entire Nation and each of its citizen. This is an instance where attempts have been made to put the reputation of the premier investigative agency of India on stake and if the matter is not thoroughly enquired and a definite conclusion arrived at, it might have dangerous consequences
8. That as far as the petitioner can think of, making such an enquiry won't have any direct impact on the pace of the investigations being done by the CBI and the two can take place simultaneously, though the conclusions drawn from your enquiry may have some definite effect on the course of this sensitive investigation, particularly if the allegations get verified in any particular manner
9. That though the petitioner does not have any added material with him at the moment but he would also be making his personal efforts to get more facts on the matter so as to be of further assistance. At the same time, he would be always willing to present himself before you in case it is ever warranted or directed.
PRAYER
On the basis of the above facts, the petitioner makes the following prayers-
1. Kindly personally enquire into the statements/ accusations of Sri Arvind Kejriwal and the IAC as mentioned in above Para of this petition
2. Kindly take all suitable and necessary measures, including taking the most stringent actions against everyone responsible for prior leaking of information as regards the impending raids and the subsequent measures to ensure free, unbiased and unhindered investigation in case some or all of the above accusations are found true
3. Kindly direct the CBI to take suitable legal action against the concerned persons, including Sri Kejriwal and the IAC, in case the allegations/ accusations are found to be false and frivolous after having undertaken the required enquiry.
