Please find attached a file on  a Landmark Judgement on Police Encounters that could be handy tool at the hands of the HRDs. 

This is first of the series. More such tools will be sent to you periodically.

In a Landmark Judgment Supreme Court issued 16 Guidelines to be followed in the matters of investigating police encounters in the cases of death as the standard procedure for thorough, effective and independent investigation. A two Judge Bench comprising of CJI Lodha and Justice RF Nariman held that Article 21 of the Constitution of India guarantees "right to live with human dignity". Any violation of human rights is viewed seriously by Court as right to life is the most precious right guaranteed by Article 21 of the Constitution. It is also held that killings in police encounters affect the credibility of the rule of law and the administration of the criminal justice system.

Land Mark Judgment of Supreme Court of India Criminal Appeal No.1255 of 1999, Transfer Case (C) No.27 of 2011 ENCOUNTER KILLINGS OF POLICE HAVE BEEN TREATED AS MURDER Under Section 302 of I.P.C. and F.I.R. should be registered against persons involved as per the guidelines.

Land Mark Judgment of Supreme Court of India ENCOUNTER KILLINGS OF POLICE HAVE BEEN TREATED AS MURDER Under Section 302 of I.P.C. and F.I.R. should be registered against persons involved as per the guidelines. ALL ENCOUNTER KILLINGS MUST BE INVESTIGATED BY THE HUMAN RIGHTS COMMISSIONS OF INDIA SO THAT JUSTICE WILL BE RENDERED TO THE VICTIMS AND THEIR FAMILIES AND COMPENSATION SHOULD BE AWARDED TO DECEASED PERSON FAMILY.
