[rti4empowerment] Re: Voters explore the ‘right to reject ’ TNN | Jan 5, 2012, 05.38AM IST

 

I have myself used this right under Rule 49-O and there is noting like as mentioned in the Post No. 52 above.

First of all exercising $(-O right is not a Right to Reject. It is merely one is abstaining from voting.

Number 2 - The right exercised under 49-O is not a confidential franchise. It is all open and for every body to see and access. I have applied under RTI Act 2005 for the copies for the Form 17-A, where it was recorded by the presiding Officer that I am exercising my right under Section 49-O.

Thirdly - Voter does not have to give a reason to exercise his right under Rule 49-O except to declare the he wishes to do so. 

And lastly, it is not like it that if more than 50% 49-O voting is done, constituency go for a repoll. However, it may result in the forfeiture of security deposit of the candidate(s) who are polled less then the threshold number of votes.
