[rti4empowerment] Rajasthan SIC gives almost a ONE YEAR time period to RajasthanHC FOR GIVING info to a RTI Applicant !!

Dear Friends,

Rajasthan State Information Commission (RSIC), in a written notice, grants almost a YEAR's time period to the Public Information Officer of Rajasthan High Court, 'FOR GIVING' (forgiving?) Information to a RTI Applicant, which is clearly in violation of the provision of sec. 7(1) of the RTI Act.

(Rajasthan SIC Notice Dated: 13-March-2013 directs the PIO of Rajasthan High Court to give information by 23-December-2013 - Notice attached herewith this e-mail)

Interestingly, in the same Notice, the Rajasthan SIC apprises the PIO of Rajasthan High Court, that if he does not provide the information in almost a Year's time, then he can be penalized under section 20(1) of the RTI Act !!!!!

I understand that RTI Act does not specify a time period for an Information Commission to dispose of a Second Appeal u/s. 19(3) or Complaint u/s. 18(1) filed before it, but then that is not true of section 7(1) of the RTI Act, which very clearly specifies the time period for providing a requested information i.e. "in normal circumstances within 30 days and in cases where Life & Liberty is involved, within 48 hours" of the receipt of a RTI application from a citizen.

Please find the text of Rajasthan SIC's Notice, quoted below (it's in Hindi language):

१. अपीलर्थी द्वारा सूचना का अधिकार अधिनियम - 2005 की धारा 19 (3) के अंतर्गत एक अपील (प्रति संलगन) प्रस्तुत कर अंकित किया है की उनके द्वारा सूचना हेतु धरा 6 (1) के अन्तर्गत प्रस्तुत आवेदन पर आप द्वारा कोई निर्णय नहीं लिया है, अथवा प्रदत्त्त सूचना प्रार्थना पत्र के अनुरूप नहीं है ।

२. आपको इस नोटिस के जरिये निर्देशित किया जाता है कि इस अपील का बिन्दुवार उत्तर दिनांक 23-12-2013 से पूर्व इस आयोग को प्रेषीत करे।

३. उत्तर की एक प्रति अपीलर्थी को भी रजिस्टर्ड पत्र से भेजे ।

४. अवगत रहे कि सूचना प्रदान करने में विलम्ब के लिए सूचना का अधिकार अधिनियम 2005 की धारा 20 (1) में दण्डित किये जाने का प्रावधान है ।
