On the attached application, S*C stayed the operation of its own judgment
in the "information commissioners appointment" case of last year in so far
as it lays down that **all Information Commissions shall work in benches of
2 members and one of them would be a judicial member. SC said that these 2
directions are not found in the RTI Act therefore it is stayed.*
SC also directed that all vacancies to be immediately filled up in all the
information commissions in accordance with the RTI Act and also in
accordance with the rest of the judgment (which relate to transparency in
apppointments.
The above order came after Mr. Bhushan appearing for the applicants Mr.
Shailesh Gandhi (former Information Commissioner at CIC) and Mrs Aruna Roy
(social activist and member NAC) submitted that these 2 directions have
created a lot of uncertainty in function of commissions and also the
vacancies are not being filled up due to the pendency of the review
petition,
