Avail alternate remedy of registering FIR about Ads on Sex-power, obesity etc- High Court
The Allahabad High Court, Lucknow Bench today disposed off the PIL as regards open violation of provisions of the Drugs and magic Remedies (Objectionable Advertisement) Act 1954 at the same time directing us to avail alternative remedy of registering FIR against the concerned persons. The Bench of Justice Uma Nath Singh and Justice Dr Satish Chandra ordered that since the alternative remedy of registering FIR against accused newspapers and companies is available, hence we shall first avail this remedy and shall approach the High Court in case we fail to get suitable remedy at that level.
I, along with wife Nutan, had prayed that as per section 3 of this Act, no advertisement about increasing sexual pleasure, women menstrual disorder and 54 diseases including Diabetes, Blindness, deafness, insanity, leucoderma, obesity etc can be published while as per section 5, all kinds of magic remedies like talisman, kavach, tantra etc is completely prohibited. Section 7 makes their violation a cognizable offence punishable between six months to one year. Hence, the Ministry of Information and Broadcasting, RNI and DAVP be directed to insure that no such illegal advertisement get published in any newspaper or TV and if it happens then all administrative and legal measures are taken.
This decision will come very useful to us to get registered such FIRs against these illegal advertisements and the newspapers/TV channels that publish/relay them and to take further steps in the direction of stopping such incidences.
