The Supreme Court today reserved its verdict on a batch of petitions
challenging the appointment of Mr P J Thomas as Central Vigilance
Commissioner (CVC).

A bench comprising Chief Justice S H Kapadia and Justices K S
Radhakrishnan and Swatanter Kumar reserved the judgement after hearing
the parties in the case.

Earlier, counsel for the petitioner, NGO Centre for PIL, pleaded
before the court that for future appointment of CVC impeccable
integrity of the candidate and unanimity of the three-member panel
comprising Prime Minister, Union Home Minister and Leader of
Opposition in Lok Sabha should be a pre-condition for the selection
and the list of shortlisted candidates must be put on the website to
maintain transparency in the selection of the head of the top
anti-corruption watchdog of the country.

Also said that if the CVC is selected by a majority then the purpose
of introducing the Leader of the Opposition in the panel shall be
defeated.

He contended that consideration of irrelevant factors and
non-consideration of relevant factor amounts to arbitrariness in the
selection. He also pointed out that in the selection of Mr Thomas as
CVC,two judgements, one of theSupreme Court refusing to quash the FIR
in palmolein oil import scam case and the other of Kerala High Court,
were ignored.

He said vigilance clearance for Mr Thomas was given in violation of
the rules of the CVC Act.

Earlier Attorney General G E Vahanvati and senior counsel K K
Venugopal defended the appointment of Mr Thomas as CVC.
