Sub. : Memorandum to sack Gayatri Prasad Prajapati & Mehboob Ali from their cabinet berths for alleged charges of corruption & a lokayukta probe to ensure free and fair inquiry against them and also to take immediate action on all reports submitted by the UP Lokayukta to Uttar Pradesh Government & to initiate departmental enquiries to fix the responsibility for the resultant loss to the state exchequer & subsequent actions to recover this money.

Uttar Pradesh Lokayukta has formally started a probe into the allegation of corruption against Uttar Pradesh state mining minister Gayatri Prasad Prajapati on the basis of 1,727 pages complaint's documents he has before him.A complaint was filed with UP Lokayukta NK Mehrotra by Om Shankar Dwivedi on December 11,2014 against the minister alleging that he has amassed wealth disproportionate to his known sources of income. In the complaint, it has been alleged that Gyatri and his family members have properties in Amethi, Lucknow and Mohanlalganj.Dwivedi also mentioned five companies in which Gyatri, his wife and son are directors.It has been alleged that the mining minister amassed assets worth crores of rupees misusing his office.
Close on the heels of allegations of the state's Mining Minister Gayatri Prasad Prajapati amassing huge wealth through corrupt deals, another minister in the Akhilesh Yadav cabinet has been accused of taking bribes to make blacklisted schools and colleges centres for the forthcoming UP board examinations.A complaint has been filed with the state Lokayukta Justice (Retd) N K Mehrotra against Minister for Secondary Education Mehboob Ali accusing him of taking bribes from the managements of schools and colleges, which had been blacklisted after allegations of mass copying there in the past examination, to allow them to become centres again this year.The complaint has been filed by the manager of a school in UP's Hardoi district. The complainant alleged that the minister had granted recognition to the schools which did not have even enough rooms to conduct classes."Lakh of ruppes had been paid by such schools to get recognition," said complainant
Bhagat Tejgiri.He also alleged that the minister was patronizing the nakal mafia, the organized gangs, which facilitate use of unfair means during the board examinations. Just a few days back, a senior official in the Secondary Education Department, who had taken on the mafia and blacklisted several schools and colleges infamous for mass copying, was removed from his post and transferred elsewhere.
Through this memorandum, we are raising our demand to sack these two ministers facing graft charges from UP Cabinet. TAHRIR demands that these cabinet ministers, who are facing lokayukta probe in alleged graft cases against them, should immediately be terminated from the post of ministers so that the investigation is not affected at all. We are sending this memorandum to both you, namely the Governor and as the chief minister of the state, with the demand to both of you, to take necessary actions to immediately sack these two ministers who face charges of corruption and a lokayukta probe because Continuing them as minister would surely affect free and fair inquiry.
We, at TAHRIR are well aware that Uttar Pradesh Governor has recently written a letter to the chief minister seeking 'explanatory memorandum' on the action taken against four BSP ministers and eight other officials against whom Lokayukta had made recommendations, finding them guilty of corruption and other charges. Referring to the special representation received from the Lokayukt in this regard, Governor has asked the chief minister to promptly make available his and chief secretary's explanatory memorandum in connection with the action taken by the government on the recommendations of the Lokayukta. We are also aware that the letter from Governor also stated that the Lokayukta, after completing the investigations, had found these four ministers and eight other officials and employees guilty of corruption and other charges and had also made his recommendations expecting to be apprised of the action taken in three months time, which had then lapsed.The
Lokayukt had send special representations to the governor recently that he had not been informed with the action taken on his recommendations against BSP ministers Swami Prasad Maurya, Avadhpal Singh Yadav, Ramvir Upadhaya and Badshah Singh and others.
We are also aware about a reminder by UP Lokayukta over disqualification of two MLAs, Bahujan Samaj Party MLA from Rasra in Ballia Uma Shankar Singh and BJP legislator Bajrang Bahadur Singh from Pharendra in Maharajganj district indicted on charges of bagging government construction contracts and holding office of profit. If this is because one of the two MLAs belongs to the BJP and a decision over termination of their memberships from Assembly has to be taken by Governor in consultation with the Election Commission of India on the inquiry report submitted way-back in February 2014. We are aware that Lokayukta has informed the governor once again about the findings of his inquiry report.
BSP MLA Uma Shankar Singh was heading a sole proprietorship firm that was awarded work contracts by PWD worth crores. Same was the case with BB Singh of the BJP. Being public servants they cannot hold an office of profit.Hence, their actions disqualify the two under section 9 (A) of the Representation of Peoples' Act and Article 191 (E) of the Constitution.
Through this memorandum, we are also raising our demand to take immediate action on all reports submitted by the UP Lokayukta to Uttar Pradesh Government and also to initiate departmental enquiries to fix the responsibility for the resultant loss to the state exchequer & subsequent actions to recover this money.
