PROSCRIBED PROCEDURE
From where the Commission draw Powers to 'Reserve Decisions' under Right to Information Act 2005
Hon'ble Sirs,
This communication is with reference to the ongoing Complaint Cases Numbers 5871/2013 and 5872/2013 in which the Haryana State Information Commission has recently reserved the decisions as the matters was heavily tilted against the Public Authority and Public Information Officer. Earlier in these cases the hearings were held without serving Notice to Complainant and without ensuring his appearance of the complainant, as no notice of hearing was sent to the complainant.
RTIFED is of the view that such cases where freedom of expression, human rights defenders and humanitarian law are under attack in India. This, the Reserving the Decision, is the case where the Information seekers are harassed and hence, overawed RTI activists and human rights defenders. That, the Haryana State Information Commissioner (and the others, as well) has arbitrarily stopping the free flow of Information to the citizen and when the flow of information is suppressed, the people's Right to know, seek, obtain, receive and hold information is grossly violated.
