Sub.: RTI users' victimization by Uttar Pradesh State Information
Commission & state police: Cases of Murder of transparency &
accountability and blatant violation of Human Rights in Uttar Pradesh
: Request to initiate a probe and punish all offenders and help us
bloom transparency & accountability to curb corruption in public life.

I Got copy of FIR filed against RTI user Ashok Kumar Goyal, a sober
and fragile man in his sixties. I have personally seen Goyal, a RTI
user and so I have every reason to blame the deteriorating law & order
situation in Uttar Pradesh on inefficient and sycophant police
personnel like Kamla Kant Tripathi who despite being a sub-inspector
of U. P. Police that too in the presence of 5 other staff including
Information Commissioner Arvind Singh Bisht & his GUNNER failed to
handle a lone, unarmed senior citizen with a lean & thin built who
even failed to snatch the arm of Tripathiji. Imagine what would happen
if a group of hardcore criminals reach UPSIC with bad intention? How
will Kamla Kant Tripathi like police personnel and alike gunners
handle the situation then? So in my view they are not fit to be in
police force and should be shunted out of police force at once or
security of UPSIC or of place where they are deputed shall always be
at risk.

The text of FIR suggests that God has gifted Kamla Kant Tripathi the
most sensitive ears on earth and that's why he was able to hear the
discussion going on in the room behind one after another i.e. two
doors from the corridor where Tripathi was said to be standing. It May
be in national interest if Government of India should utilize this
quality of Kamla Kant Tripathi for spying against our enemy nations
and make him a master trainer for this art.

When Tripathi utters UPSIC as a court of law, I can't help
appreciating the biased attitude of Kamla Kant Tripathi which is the
same as of our information commissioners because when it comes to
victimize the info seekers, they all knew it that UPSIC is a court of
law but they forget it when info-seeker reminds this to them to invoke
it against PIOs. Our information commissioners have never used powers
of a court of law against any of the respondents. This doesn't mean
they have never used it against info-seekers. Many a times UPSIC had
sent contempt of court notices ( U/S 345 CrPc read with section 228
of IPC ) to info seekers. May be a fair inquiry would establish that
UPSIC was very much responsible for the recent murder of RTI user
Mangat Singh Tyagi of Hapur. Ashok Kumar Goyal , me or some other RTI
user may be the next target of corrupt system of
bureaucracy-politician-Info commissioner nexus of Uttar Pradesh.

Its very very surprising that on one hand Sub Inspector Kamla Kant
termed the acts of RTI user senior citizen Goyal as spreading terror
meaning thereby that Goyal happened to be a terrorist to him but said
Sub Inspector alongwith Gunner Avinash Tiwari & other staff including
Bishtji failed to overpower this unarmed senior citizen and
immediately hand him over to police. Unarmed Goyal not only easily
left the premises of UPSIC but reached his home also. Don't you agree
that such useless sub inspector and gunner be immediately removed
from government duties or else the precious lives of our learned
info-commissioners or citizens of U.P. are at great stake.

The incident took place at 2 PM but it took good 6 & a half Hours to
cover a short distance of two kilometers that too in the posh
Hazratganj area of state capital with ample transport facility. I bet
that in 6 & a half Hours I shall make a snail or tortoise reach
Hazratganj Thana from UPSIC but Kamlakant failed to do so. Now I can
easily understand the deteriorating law & order situation in Uttar
Pradesh. Earlier I was blaming it on Goondaraaj of Samajwaadi Party
but now I can understand that this is because of police personnel like
Kamlakant who are actually responsible for deteriorating law & order
situation in Uttar Pradesh. After elections Akhilesh led Government
should initiate a drive to investigate all those police personnel who
work at snail-pace err………… at Kamla-Kant-Tripathi-Pace and shunt them
out of job because they are doing no good to the system but eroding
our hard earned money, being paid to them as salary.

Casting a glance at medical examination report of Goyal, issued by
Civil Hospital of Lucknow makes me shiver to see the apathy of Police
department towards human rights of a common man. Many a times I have
seen the same police keeping hardcore criminals in hospitals just to
provide them ample time to dilute the wrath of law towards them but in
this case senior citizen Goyal, with blood pressure 174/96 and who was
referred to ICCU for expert opinion was not left at hospital but was
at Hazratganj police station lock-up and later in court of CJM
Lucknow. I don't have courage to comment on CJM court but I want to
bring this to your kind notice that CJM, though first passed order of
grant of bail to Goyal on 25-04-14 but later denied the same and Goyal
was sent to jail. Goyal could get bail on 26-04-14 that too after
active intervention of rights' activists and media personnel.
Shouldn't police station officer of Hazratganj police station be
punished for this blatant violation of Human rights of a senior
citizen.

I don't know about 7 criminal law amendment but am sure that though
none of the crimes as reported in FIR attract punishment of more than
7 years but despite this police arrested Goyal from his residence in
the middle of the night. Its surprising that police sub inspector
Kamla kant tripathi took 6 hours and 30 minutes to cover 2 Kms to file
FIR but Hazratganj police reached Goyal's residence at Scotland Yard's
pace. Nice example of appeasement of Political masters by U.P. police
for personal gains. Should't this be thoroughly probed as to why
police altogether acted differently? Yes this has to be, so please
get this probed.

Section 4(1)(d) of RTI act mandates every public authority to provide
reasons for its administrative or quasi judicial decisions to affected
persons but its strange that Bisht,( said to be) a noted journalist (
I doubt if he really was a journalist at heart) and ( said to be ) one
of the custodians of RTI act in U.P., Bisht himself fails to comply
this section of RTI act and adjourns hearings without providing any
reasons of such adjournments to the info-seeker who comes all the way
from far off place of U.P. that too at his/her own cost. Without any
specific reasons cited for such adjournments, I have every reason to
doubt that Arvind Singh Bisht announces these adjournments either for
playing his favorite online game or lottery or movie on internet or
may be for striking money deals with PIOs to let them go scot free
without providing corruption related information. Had Bishtji provided
reasons for adjournments, such apprehensions might not be there.

Though I know that Arvind Singh Bisht is a Kin to my Chief Minister
but I am risking my life to blame him as being a habitual late comer
to UPSIC and thus causing damage to the public resources, breaching
the contract of full day work despite taking full salary and
obstructing the government work ( read public work ) assigned to him.
Will any authority in India shall ever probe this on the basis of
location of his mobile on all working days at UPSIC? If not then its
better government should bring an ordinance to stop such
info-commissioners from holding hearings at UPSIC while paying all
parts of salary,perks and facilities to Info commissioners err……..
such relatives and near & dears of Government and help info-seekers
come out of illusion of there being a help named RTI act or UPSIC.
And also…….. for God sake stooooooop talking against corruption
instead start taking of nurturing corruption because this is all what
they are doing. Please stop having double,triple faces.

Of course there are some Info-commissioners at UPSIC who are doing
their job to the best of their abilities and I am raising my demand
that after retirement of Chief Information Commissioner pending
regular appointment, charge of Chief Information Commissioner should
be given to the most eligible Information Commissioner to be adjudged
on the basis of evaluation report of RTI cases handled by him. Such
evaluation should necessary be done by a third party.
