Today Hon'ble Chief judicial Magistrate, Lucknow Sri Rajesh Upadhyay ordered the Gomti Nagar police to register a criminal case under appropriate sections against Sri Nirmal Baba, a Delhi based Godman and investigate it. The CJM gave this order on the application presented by my two children Tanaya (a student of class 12) and Aditya (a student of class 10) under section 156(3) CrPC. The order said that as per the application presented by Tanaya and Aditya, a prima facie case is found out and there are adequate grounds for registering the FIR. He referred to the Supreme Court judgement in Sri Bhagwan Samardha vs State of AP where a similar kind of cheating in the name of medical treatment was done by a Godman.
Tanaya and Aditya had submitted that Sri Nirmal Baba was cheating ordinary and poor Indians through his improbable solutions which they came under the act of cheating under sections 417, 419 and 420 IPC and under section 508 IPC where Godly fear is used. They had gone to Gomtinagar police station on April 10 to get the FIR registered and when the FIR was not registered by the police, they had filed an application before the CJM, Lucknow on April 17 to get the case registered.
In his report sent by the police to the Court on April 24, it had said that the complainants are not directly affected. He had also said that the complainants were not providing any further evidence and witness, hence the matter was not getting ahead. The Court did not agree to these objections and ordered registering of FIR.
