RTI- Pol parties given Govt houses at throwaway rent

Information provided by the Estate Department, Uttar Pradesh to my wife, RTI activist Nutan Thakur shows that the State government has allotted government houses to various political parties at almost throwaway rents.

As per the information, the Congress Office at 7, Mal Avenue has a per month rent, including water charges, of Rs. 2428. The Samajwadi Party office at 19A Vikramaditya Marg pays a monthly rent of Rs. 2425 while the Samajwadi Yuvajan Sabha office at 6A Lal Bahadur Shastri Marg pays rent of Rs. 2525 per month.

The Janata Dal office at 38D Major banks Road pays a monthly rent of Rs. 2026, the BJP office at Vidhan Sabha Marg pays a monthly rent of Rs. 4849, the Lok Dal office at 9B Triloki Nath Road pays Rs. 2046 and the CPI(M) office at Vidhan Sabha Marg pays a monthly rent of Rs. 2008.

The Loktantrik Congress occupies an office near Vidhan Sabha paying a monthly rent of Rs. 2425, despite the Estate department having cancelled its allotment.

As against these abysmally low rents, even a small 2 Bed-room apartment in these prime locations in Lucknow has a rent not less than Rs. 10-15 thousand per month while a small independent house of 2000 square feet has a rent more than one lakh per month.

Serious complaints against Sahara India

I, along with Nutan have demanded enquiry as regards money-collection scheme of Sahara India through Sahara Q shop and Sahara Credit society.

In the complaint to Securities and Exchange Board of India (SEBI) along with the Corporate Affairs Ministry, we have said that it is being widely alleged that along with Sahara Q shop scheme, Sahara India is collecting public money through a new entity, Sahara Credit cooperative society, having variety of schemes like Sahara E shine, Sahara A Select, Sahara Minor, Sahara M Benefit etc.

As per the complaint, this society is registered with the Ministry of Agriculture, Government of India and is collecting money against the rule of law as regards collection of public money. Thus just like what the Supreme Court said in its order as regards Sahara India Real Estate Corporation Limited (SIRECL) and Sahara Housing Investment Corporation Limited (SHICL), these money collection in Sahara Q shop and Sahara credit society seem to come within the definition of "securities" as defined under Section 2(h) of Securities Contracts (Regulation) Act, 1956 where Sahara India seems to be contravening the provisions of Sections 56, 73, 117A, 117B and 117C of the Companies Act along with the various clauses of the Securities and Exchange Board of India (Disclosure and Investor Protection) Guidelines, 2000 and the Securities and Exchange Board of India (Issue of Capital and Disclosure Requirements) Regulations, 2009.

We have said that we had previously sent their complaint on 02 January but no action has been taken so far and if these complaints are not enquired within time, it might prove extremely detrimental to interest of the helpless investors.

LUCKNOW: An RTI application seeking information from the Delhi chief minister's office generated no reply except that the said application has been transferred to the department concerned.

If RTI reply to activist Sanjay Sharma is to be believed, Arvind Kejriwal's claims on inquiries initiated by his short lived government in matters related to previous governments, cabinet approval of Delhi government's decision to grant 50% waiver on pending electricity bills and tabling of Jan Lokpal Bill in Delhi assembly could not generate even a single piece of document in chief minister's office.



  Sharma had sought department wise information of inquiries initiated by present government in matters related to irregularities of previous governments.

He had also asked for certified copies of all documents including note sheets contained in files related to cabinet approval of Delhi government's decision to grant 50% waiver on pending electricity bills of consumers, besides other information on February 13.

Delhi Police have declined to share information about any action taken against former Supreme Court judge Justice A K Ganguly in an alleged sexual harassment case of a law intern, Lucknow based RTI activist Urvashi Sharma said.

Sharma had sought information under the Right to Information Act from Delhi Police about action taken against Justice Ganguly. She sought to know if there was any provision that barred police from taking cognisance of the matter in the way Goa Police had done in the Tarun Tejpal case.

Study report on status of RTI in UP government

While section 4 of the RTI Act says that every public authority shall maintain all its records duly catalogued and indexed and ensure that they get computerized so that all important details related to these public authorities get published within 120 days of enactment of this Act, the ground realities seem to be quite contrary to this mandate.

These facts were brought through a study conducted by me and wife Nutan.

We two studied the status of RTI in 81 Departments of the UP Government mentioned at the Home page of the website of Uttar Pradesh government (http://upgov.nic.in/allsites. asp), particularly as regards the mandatory information that needs to be provided under section 4(1)(b). The study found that almost none of them have provided the rules, regulations, instructions, manuals and records, held by them for discharging its functions in the electronic form.

It was also found that many of these information are quite old. Thus names of Nasimuddin Siddique in Cane development, Narayan Singh in Horticulture, Lalji Verma in Parliamentary Affairs and J N Rai in Handloom department remain on official records, while they left the office as way back as March 2012. Similarly, the names of such long retired officers like R K Sharma in the Horticulture, Sri Krishna in Handloom and S C Gupta in the IT Department is written.

Names of the PIOs and Appellate Authority of many departments are outdated while in many cases only the names and no other necessary details have been provided. Similarly in most cases, the years of the Budget presented on website has not been specified while in many other cases, the Budget of year as early as 2008-09 or 2009-10 have been provided.

Departments like Basic Education, Coordination, Culture, Finance, Fisheries, Infrastructure Development etc have provided almost negligible information. Samagra Gram Vikas, Small Scale Industries and Export Promotion Departments do not even mention about the RTI Act while Revenue and Vidhai departments have links to the RTI section but these links are not operational. The Governor office has information only in English while the Chief Minister office has limited information provided under RTI Act.

Yes, there seems to be an imminent need to pursue the matter to bring it to its logical end.
