Lawyers demand cleaning courts of 'uncle practice'

JABALPUR: Lawyers in MP high court have come out in open and demanded urgent measures to cure court rooms of "uncle practice",- a "malaise which is allegedly adding to much confusion and corruption and is also hampering the cause of justice"
In its joint executive meeting on Friday, Madhya Pradesh High Court Bar Association MPHCBA and the State Bar Council (SBCMP) have called for drastic measures to curb the growing influence of a powerful lobby of touts who are flaunting their proximity to sitting judges to make a neat pile.
The issue was first raised at the general meeting of MPHCBA and MPSBC on June 29 where members slammed the trend by passing a resolution . the resolution, of which TOI has a copy ,categorically pointed an accusing finger at section of lawyers who have been either" juniors of a high court judge prior to their elevation" or "close relatives". "This group is looting the gullible litigants by promising them guaranteed justice from such the judges by charging them a hefty sum." The resolution read as it claimed that the development was s leading to much resentment in the bar.
The copy was handed over to law minister Kapil Sibbal by chairperson SBCMP Shivendra Upadhyay. "It is certainly not a happy situation for us, but we have been forced to take this drastic and unprecedented step" Upadhya told TOI." Judges' affinity and soft corner for their kith and kin or their juniors is nothing new. However the brazenness of putting favoritism and nepotism above everything is becoming increasingly intolerable and unless checked in time, would result into collapse of the entire judicial system", declared the veteran lawyer.
On Friday the executive meeting prepared the blueprint of the strategy which will be given finishing touches on July 11 at the general body meet, president MPHCBA Adarsh Muni Trivedi told TOI. The association, he said, has already identified 360 such touts." We propose to demand stringent action against them including registration of FIR and criminal cases and even arrest. The association could also call for a ban on their entry into the court premises. This apart we are also compiling specific complaints received from duped litigants. All this will be forwarded to the chief justice of India to apprise him of the thriving racket", Trivedi said.
What we basically want is implementation of the recommendations by law commissions report by justice AR Lakshman. Justice Lakshman had expressed misgivings about elevating lawyers and posting them in the same high courts where they had been practicing in view of their past affiliations, former assistant solicitor general of India and SBCAP member Radheylal Gupta. "We, he said, are forwarding the copies of our resolutions to the bar councils in all states so that a strong appeal is raised against this rampant malpractices.
