"Their unauthorised use causing serious concern"
The Madras High Court on Thursday issued guidelines to be followed by the Tamil Nadu government in the matter of use of beacon lights.
Passing further orders on a public interest litigation petition regarding misuse of red beacon lights by persons who were not authorised to put the lights atop their vehicles, the First Bench, comprising Chief Justice M.Y. Eqbal and Justice T.S. Sivagnanam, said red light with flasher on the top front of the vehicle should be used by the Governor, Chief Minister, Deputy Chief Minister, Chief Justice, Judges of the High Court, Speaker of the Legislative Assembly, Cabinet Ministers, Leader of the Opposition, State Ministers, Advocate-General, Chief Secretary, DGP, Chairman of the Legislative Council, State Election Commissioner, Lok Ayukta, Chairman of the Advisory Board constituted under the NSA and under the Tamil Nadu Act 14 of 1982 (popularly known as Goondas Act), the Nawab of Arcot Mohd. Abdul Ali and pilot and escort vehicles.
Those permitted to use amber (yellow) light atop their vehicles while on duty are: Chairman, TNPSC, District Collectors, Superintendents of Police, District Judges, Chief Metropolitan Magistrate/Chief Judicial Magistrate, High Court Registrar-General, range DIG of Police, IG of Police, Law and order, South Zone at Madurai, Secretaries to Government, all department Commissioners/Secretaries, Accountant-General, Regional Inspectors-General, Transport Commissioner, Heads of Departments and Treasury Officers.
Ambulance, fire service
The court authorised ambulance and fire service vehicles to use yellow/blue light as per the earlier practice while attending to emergency calls in the course of their duty. When the petition came up, the Government Pleader said that the government was not in a position to take a policy decision in the matter because of the prevailing situation, but guidelines issued by the court would be followed.
The Bench said unauthorised use of red beacon revolving lights on top of vehicles was causing serious concern from the security angle. On many occasions, policemen were seen allowing such vehicles to pass through, even at checkpoints, without enquiring as to who was inside.
It issued the guidelines after considering the notifications issued by different States. The Bench said it was brought to its notice that sometimes members of the subordinate judiciary were using red light, plates or plaques etc in violation of the government notification. If that was so, today's order should be circulated among them.
The Bench made it clear that a private vehicle not carrying constitutional functionary or persons entitled to use red or yellow light should not be permitted to place such light attop the vehicle. The DGP should issue necessary instructions of compliance of the court order.
