[rti4empowerment] Re: IN SUPPORT OF CARTOONIST ASEEM TRIVEDI

Dr Leo,
Hats off to you for timely written factual and good article.
It is a shame that Judiciary has been giving bails to murders but giving remand to karntikari working to save India.

I have filed factual written complaint under 498A and 406 but police is taking its own time, dawood would not have been dawood if police had acted but they r acting against saviours of India.

History will curse such police (though all are not same but the few bad ones are enough to spoil image of whole staff), Judges and rulers.

Judges in India order as they like, they pass order to my mind.......as per me.....and  even similar cases their orders can be different depending on factors which u cant narrate. In Pakistan u are afraid of Taliban and can't say anything against same and in India u can't say even factual analysis of Judiciary or u will be behind bars.
Same Judiciary gave anticipatory bail to youth congress leader who burnt his wife in Tandoor but sent Aseem to jail.

Thanks and Regards,

Subject: IN SUPPORT OF CARTOONIST ASEEM TRIVEDI

Dear Editors: This refers to the arrest of Cartoonist Aseem Trivedi on a weekend as if
he is
a underworld who may escape to Pakistan to serve in the ISI.

I would also like to compliment Justice Markandey Katju, Chairman of the PCI,
who said: "My opinion is that the cartoonist did nothing illegal". He further adds:
"Policemen who make such illegal arrests, cannot take the plea that they
were
obeying orders of political superiors".

I have seen Aseem Trivedi's cartoons on Facebook and they present factual picture.
Aseem is not insulting the national symbols or emblems; he is commenting through
these symbols (which is the
fine art of expression) that how the nation of Lions has
indeed become a nation of Wolves due to corrupt
politicians.  Infact, criminal politicians
who disturb India's unity on
communal and casteist lines and who stash nation's wealth
in foreign banks
should be arrested under the sedition law.

Instead, by arresting a bold cartoonist on the trumped up charge of sedition when he
is doing his duty as enshrined
under  Article 51A (fundamental duties of citizens) of
the Constitution of India, the mindless Police Officer is abusing the powers. That too,
on a private complaint without
verifying the motive of the complainant.

I would also like to ask Justice Katju, why he cannot suo motu, as Chair PCI,
intervene (instead of just opining) by directing the Police to forthwith release
the cartoonist since PCI is the watchdog on the Media and the police and magistrates
must consult it first. If the PCI (which is dubbed
as a toothless tiger) cannot do it,
then the BHC or SCI
should intervene.

As rightly brought out by Katju, there are provisions in the IPC that the police can
be hauled up for making false cases, but the Magistrates
and Judges rarely take
the corrupt or incompetent police to task.

Most human rights violations take place
at the police stations and also in the MM courts due to corruption. Even in
Consumer Courts or Human Rights Courts there are provisions for interim relief,
but they are rarely granted, which leads to suffering of the law-abiding citizens due
to twisting of law by some ignorant men in uniform. That also increases the burden
on the courts by false cases which corrupt police register against activist
to subdue them. This misuse of law cannot be tolerated.

Therefore, we demand the immediate release of Aseem Trivedi so that he
can fly to Syria, on 12th Sept., to receive
the 2012 Courage Award in editorial
cartooning.

Best Wishes
Dr. Leo Rebello
