[rti4empowerment] Powers of Proposed Jan Lokpal Bill, 2011?

 

Dear Friends,

Proposed Jan Lokpal Bill, 2011, confers Power on Lokpal, to intercept and monitor messages or data or voice transmitted to Prime Minister & Chief Justice of India?? (if they are under Lokpal), kindly refer to section 29(12)  read along with Section 2(d) & Section 17 (1) of the version 2.3 of the proposed Lokpal Bill, 2011:

Section 29 (12) The appropriate Bench of the Lokpal shall be deemed to be the designated authority under Section 5 of the Indian Telegraph Act empowered to approve interseption and monitoring of messages or data or voice transmitted through telephones, internet or any other medium as covered under the Indian Telegraph Act read with Information and Technology Act 2000 and as per rules and regulations made under the Indian Telegraph Act 1885.

Section 2 (d)
"Lokpal Bench" means a Bench of 2 or more members of the Lokpal acting together in respect of any matter in accordance with the regulations. Each bench shall have a member with legal background.

Section 17 (1)
No investigation or prosecution shall be initiated without obtaining permission from a 7-Member Bench of the Lokpal against any of the following persons:-
i) The Prime Minister and any other member of the Council of Ministers
ii) Any judge of the Supreme Court or any High Court
iii) Any Member of the Parliament
