Friends, In the study leave case related with my husband, IPS officer Amitabh Thakur, the Uttar Pradesh government had filed a Writ Petition No 268 of 2011(S/B) in Allahabad High Court, Lucknow Bench against the order of Central Administrative Tribunal, Lucknow. Today (09/03/2011) the High Court dismissed the Writ petition of the State government as being without sufficient grounds. Asok Pande,Amitabh's counsel presented various facts about the case and also mentioned that Thakur was deliberately being denied even his salary for the last 2 years. The State Standing Counsel requested for some more time to file the Affidavit but the Bench of Justice Devi Prasad Singh and Justice S C Chaurasia rejected this prayer, saying that since CAT had asked to decide over his study leave matter within a given period, hence there seemed no logic in keeping it pending. High Court ordered the State government to take decision in this matter within 2 weeks. Amitabh had applied for Study Leave on 30/04/2008 for Fellow Program in Management course at IIM Lucknow. The State government did not take any decision over this matter and kept it deliberately pending for long. He filed many cases in CAT, Lucknow and Allahabad High Court. The State government rejected his study leave application on certain grounds but it granted extra-ordinary leave after CAT's order. Later in Original Application No 238 of 3009, on 07/07/2010 CAT, Lucknow ordered that the reasons specified by the State government for refusing Thakur's study leave were unsustainable and ordered them to consider his claim for study leave as per rules.
