पूर्व मुख्‍य सचिव जावेद उस्‍मानी को नए मुख्‍य सूचना आयुक्‍त के अखिलेश सरकार के फैसले को राजभवन से मंजूरी नहीं मिल पाई है। राज्‍यपाल राम नाइक ने सरकार के फैसले पर सवाल उठाते हुए अपनी मंजूरी नहीं दी और संबंधित फाइल लौटा दी।

1978 बैच के आईएएस अधिकारी जावेद उस्‍मानी फिलहाल यूपी बोर्ड ऑफ रेवेन्‍यू के अध्‍यक्ष हैं। हाल ही में मुख्‍यमंत्री अखिलेश यादव ने उन्‍हें मुख्‍य सूचना आयुक्‍त नियुक्‍त किया था।

सूत्रों का कहना है कि जावेद उस्‍मानी का पिछला कार्यकाल काफी विवादित रहा है। उनके खिलाफ कई आरोप लगाए गए थे। इसके बावजूद प्रदेश सरकार ने सारे आरोपों को दरकिनार कर उन्‍हें राजस्‍व परिषद में उन्‍हें चेयरमैन बनाया गया।

इधर, ट्रांसप्रेंसी अकाउंटबिलिटी एंड ह्यूमेन राइट्स इनिशिएटिव फॉर रिवोल्‍यूशन (टीएएचआरआईआर) ने उस्‍मानी को लेकर राजभवन को सावधान करते हुए ज्ञापन दिया था। इसमें कहा गया कि हिंडाल्‍को कोयला घोटाला में सीबीआई को जावेद उस्‍मानी की भूमिका संदिग्‍ध रही है। जांच एजेंसी ने उस्‍मानी से इस संबंध में उनसे पूछताछ भी की थी।

विश्‍लेषकों का कहना है कि सूचना आयुक्‍त के प्रमुख का पद संवैधानिक है। ऐसे में किसी राजनीतिक पृष्‍ठभूमि या विवादासस्‍पद शख्‍स की इस पद पर नियुक्ति नहीं की जाती है।

#लखनऊ #उत्तर प्रदेश उत्‍तर प्रदेश के पूर्व मुख्‍य सचिव जावेद उस्‍मानी के अधिकारिक तौर पर उत्‍तर-प्रदेश सूचना आयोग के मुख्‍य सूचना आयुक्‍त (सीआईसी) के रूप में नियुक्ति से पहले ही विवाद शुरू हो गया है।

1978 बैच के आईएएस अधिकारी उस्मानी अभी यूपी बोर्ड राजस्‍व के अध्‍यक्ष पद पर कार्यरत हैं। सोमवार को मुख्‍यमंत्री अखिलेश यादव की अध्‍यक्षता वाली चयन समिति ने उनका नाम को मंजूरी दे दी है। सूत्रों ने बताया है कि यह फैसला राज्‍यपाल राम नाइक के पास भेज दिया गया है और वह इस पर अंतिम मोहर लगाएंगे।

सूत्रों के मुताबिक, उस्‍मानी की नियुक्ति से पहले सरकार को कई बाधाओं का सामना कर पड़ सकता है। एक गैर लाभकारी संगठन पारदर्शिता, जवाबदेही और मानवाधिकार क्रांति के लिए पहल (टीएएचआरआईआर) ने राज्‍यपाल को उसमान के खिलाफ एक ज्ञापन सौंपा है, जिसमें उन्‍होंने कहा है कि वह 2016 में रिटायर हो जाएंगे।

ज्ञापन में कहा गया है कि उसमानी का हिंडाल्‍को कोयला घोटाले में संभावित भागीदारी हो सकती है। केन्‍द्रीय जांच ब्‍यूरो (सीबीआई) ने पहले इस मामले में उत्‍तर-प्रदेश के मुख्‍य सचिव और प्रधानमंत्री कार्यालय के पूर्व संयुक्‍त सचिव जावेद उसमानी से पूछताछ करने का फैसला किया था। हालांकि जांच एजेंसी विवादास्‍पद कोयला ब्‍लॉक आवंटन के संबंध में उनसे एक गवाह के रूप में पूछताछ
करना चाहती थी।

उसमानी एक सेवारत आईएएस अधिकारी है और इसके लिए राज्‍य सरकार उन्‍हें वेतन देती है ऐसे में उन्‍हें पारदर्शिता की निगरानी करने वाले शीर्ष पर नियुक्ति कैसे किया जा सकता है। सीआईसी एक संवैधानिक पद है और सूचना का अधिकार अधिनियम से यह स्‍पष्‍ट होता है कि राज्‍यों को इस पद पर एक ऐसे व्‍यक्ति को नियुक्‍त किया जाना चाहिए जो अवलंबी हो और सरकार के किसी भी वेतन रोल पर नहीं होना
चाहिए।

ज्ञापन में कहा गया है कि समाज के व्‍यापक हित में हम आपसे अनुरोध करते है कि जावेद उस्‍मानी के नाम को अंतिम मंजूरी न दी जाए।

उल्लेखनीय है कि सीआईसी का पद यह पद विवादास्पद पूर्व नौकरशाह रणजीत सिंह पंकज का कार्याकाल जुलाई में खत्‍म होने के बाद से खाली हो गया था। समाजवादी पार्टी (सपा) प्रमुख मुलायम सिंह यादव के करीबी माने जाने वाले उस्‍मानी को 2012 के विधानसभा चुनावों में जीत के बाद से मुख्‍य सचिव बनाया गया है। वह पहले मुस्लिम नेता था जिन्‍हें मुख्‍य सचिव के पद पर नियुक्‍त किया गया था। हालां‍कि
लोकसभा चुनावों में हार के बाद उन्‍हें राजस्‍व बोर्ड में भेज दिया गया था।

मुख्‍य सूचना आयुक्‍त का पद सुप्रीम कोर्ट के एक न्यायाधीश के बराबर होता है जिसका कार्यकाल 5 साल या 65 साल की उम्र पूरा होने तक का होता है। इससे पहले उस्‍मानी का नाम भारत सरकार में सचिव (विनिवेश) के रूप में और केंद्र सरकार में पर्यावरण एवं वन मंत्रालय में सचिव के रूप में नियुक्त किए जाने की भी उम्मीद थी।

Jawed Usmani's appointment as CIC raises eyebrows

#Lucknow #Uttar Pradesh Even before the official announcement of the name, the appointment of Former Uttar Pradesh's (UP) chief secretary Jawed Usmani as chief information commissioner (CIC) of the UP State Information Commission has run into controversy.

The choice of the 1978 IAS officer Usmani -currently posted as Chairman of UP Board of Revenue-was approved by the selection committee that met here under the chairmanship of chief minister Akhilesh Yadav on Monday. The decision, sources said, would now be forwarded to Governor Ram Naik for final stamp on the choice.

According to the sources, Usmani's final appointment may face hurdles on account of his post. A non-profit organization-Transparency, Accountability and Human Rights Initiative for Revolution' (TAHRIR) has also sent a memorandum to the Governor warning him against Usmani, who is due to retire in 2016.

"Possible involvement of awed Usmani in Hindalco coal Scam case as Central Bureau of Investigation had earlier decided to question Jawed Usmani, the Chief Secretary of Uttar Pradesh and a former joint secretary in the Prime Minister's Office, regarding the controversial coal block allocation to Hindalco, though as a witness," the memorandum says.

That Usmani is still a serving IAS officer and draws his salary from the state exchequer, also seems to go against his appointment for the top post in the transparency watchdog. For the Right to Information Act clearly states since CIC is a constitutional post, the incumbent should not be on the pay rolls of any government.

"So, in the larger interest of the society, we are requesting you not to give a final nod to the name of Jawed Usmani," the memorandum said.

Noteworthy, the CIC post was vacated after controversial ex-bureaucrat Ranjit Singh Pankaj's term was over in July this year. Considered close to Samajwadi Party (SP) chief Mulayam Singh Yadav, Usmani was appointed as chief secretary following the party's landslide victory in 2012, becoming state's first Muslim to occupy the top bureaucratic position. He was, however, shunted to Board of Revenue soon after the SP's rout in Lok Sabha elections.

A CIC enjoys the status equivalent to that of a judge of the Supreme Court and has a term of five years or till the completion of 65 years age, whichever earlier. Not so long ago Usmani's name was doing the rounds to take over as Secretary (Disinvestment) in Government of India. Before that, he was expected to be appointed as secretary in the Ministry of Environment and Forests, in Union government.

Sir, you increased the rail fares. That is good, ......... I mean that is bad, very bad. Here is why:

You should not have acted blindly in a congress-ishly way and resorted to fare hikes. Instead, you should have got all the data AND should have also travelled incognito on a couple of long-distance trains (yes, by sleeper class and not by a/c first class) and should have analysed whether such fare hike was at all a necessity, and whether there were not other ways (yes, cutting corruption and inefficiencies).

This write suggests you take an incognito sleeper class train journey on Goa Express from Vasco to New Delhi OR you could try your hand by NE Express from New Delhi to New Jalpaiguri (there are dozens of other suggestion one could make). Had you done that, you would have found:

1. Reservations are all booked 30 days in advance. But when one actuall boards the train, it is half vaccant. Instead there is a long list of RAC and Waiting list. This is exploited by the TT's to collect Rs 200 from each person to allot a berth. Also there are at least 20 or even 30 extra passengers on board who block the entrances and exits and bathrooms and passageways (see photos). A rough calculation would show something like Rs 40,000 looted from train passengers per train per trip. Multiply that with hundreds of trains all-India, and hopefully you would get the / a picture ? A savings of hundreds of crores per year.

2. About 90% of the pantry staff overcharge. Rs. 10 instead of Rs 7 for tea, and Rs 40 instead of Rs 34 for cold drinks, etc. That is a loot of something like Rs 5000 per train per trip. Do you see something or IS IT ALL MaCullay's fault ?

This writer has offered earlier, and does so here again: For 1/2 your salary and perks, this writer will fix about 75% of the problems within 6 months !

I, on behalf of 'TAHRIR' have, through a petition opposed the selection of Jawed Usmani, An IAS officer of the 1978 batch as Chief Information Commissioner of U.P.

I, on behalf of 'TAHRIR' have put forth following facts related to dubious past and incapacity of Jawd Usmani before Ram Naik , the Governor of Uttar Pradesh and requested him not to give a final nod to name Usmani as head of transparency regime in Uttar Pradesh :

1- Possible involvement of Jawed Usmani in 2G scam related case because documents obtained under RTI by activist Vivek Garg had revealed that In a letter dated 10th January, 2006, J.S. Sarma, the then telecom secretary, wrote to Jawed Usmani, joint secretary to the prime minister, and sent a different Terms of Refrences, which were approved by the telecom minister. There Terms of Refrences were totally different from the original Terms of Refrences, in which, the pricing of spectrum was not even mentioned. This was said to be the root cause and beginning of spectrum scam.
2- Possible involvement of Jawed Usmani in Hindalco coal Scam case as Central Bureau of Investigation had earlier decided to question Jawed Usmani, the Chief Secretary of Uttar Pradesh and a former joint secretary in the Prime Minister's Office, regarding the controversial coal block allocation to Hindalco, though "as a witness".
3- Usmani has been a habitual leave taker, a fact revealed by my RTI plea so how come he shall be able to do justice with info-seekers?
4- Usmani was recently removed from the post of Chief Secretary just after Lok Sabha Elections because of his incapacity to deliver to the state as Chief Secretary so how come he shall be able to do justice with even higher post of Chief Information Commissioner of State which is equivalent to Election Commissioner of India?

Sir,
'Transparency, Accountability & Human Rights Initiative for Revolution' (TAHRIR) is a Bareilly/Lucknow based NGO working in the fields of Transparency & Accountability in Public Life and also for protection of Human Rights in India.

Through this petition/memorandum, we are bringing forth following self-explanatory facts exhibiting the great lacuna and deliberate non-cognizance of given facts by the selection committee that made a go through to the name of Sri Usmani for the post of Chief Information Commissioner of Uttar Pradesh.
We are putting forth following facts before your goodself which are related to his dubious past, his habit of being on long leaves and also about his proved incapacity:

So, in the larger interest of the society ,we are requesting you not to give a final nod to the name of Sri Jawed Usmani as head of transparency regime in Uttar Pradesh and remit the matter back to the selection committee with the direction to select a person of clean & clear past and a proved professionally successful track record on the said post.
